The term "patent" covers utility models and Supplementary Protection Cer= tificates (SPCs). Offices which issue design patents should report their de= sign patent information activities in their Annual Technical Reports on Ind= ustrial Design Information Activities.
In order to facilitate the process of European and world integration of =
Republic of Macedonia, one of the main goals of the Office was to achieve a=
higher degree of harmonization of the national legislation with legislatio=
n of TRIPS agreement and EU directives. During the year 2003, intensive wor=
k has been put into the Law Changes and Additions to the Law on industrial =
Property (Official Gazette of the Republic of Macedonia no. 47/02 and 42/03=
) which was enacted in June 2002 and became effective starting from 1st of =
July 2003 or 1st of January 2004, as well as the preparations of the bylaws=
.
In relation to the old Law, the new Law includes an additional certificate=
for protection of patents. With this change, one may prolong the validity =
of patent right for more than 20 years for those inventions pertaining to m=
edical product or plants whose commercialization requires a prior administr=
ative procedure to be carried out. Different solution in compliance with in=
ternational conventions and treaties has been determined with introduction =
of minimum requirement that have to be fulfilled in order to convert date o=
f receipt of submission into a date of filing of application.
The number of filed patent applications in 2003 has increased in compariso=
n to 2002 by 80.5% primarily due to the increase of the number of patent ap=
plications filed by foreign applicants. According to statistical data this =
Office in 2003 received 435 patent applications, or 47 domestic and 388 for=
eign.
The structure of the filed applications according to the International Pat=
ent Classification shows that section A (consumables) has the biggest share=
or 43.5%, followed by section C(chemistry, metallurgy) 29.4%, which presen=
ted the structure of the production capacities in Macedonia.
The State Office of Industrial Property of The Republic of Macedonia iss=
ues official gazette =E2=80=9CGlasnik=E2=80=9D. The Gazette is issued four =
times a year, every three months.
This official gazette contains publishing of recognized patents their abst=
racts and drawings if any. Regarding the regional European patents seeking =
protection for Republic of Macedonia in accordance with the Agreement on co=
-operation in the field of patents with the European Patent Office, the bib=
liographic data, patent claims and drawings are published, respectively.
There are very often commentaries of actual activities in protection of th=
e industrial property rights. The Office issues Annual Report for its activ=
ities in the former year. In this Report there is basic statistic data for =
patent applications and patents.
All patent documentation is classified according to the IPC classificati= on, the seventh edition. All bibliographic data are published in accordance= with the suggested INID codes by WIPO standards.
The patent documentation is of paper kind and is based in the Office lib= rary. The documentation is updated continuously.
For the period of this year there was no global in-house system in place=
yet, but towards the end of the year the Office, in cooperation with WIPO,=
started an implementation of the IPAS Software which is planned to gradual=
ly encompass all three major IP domains beginning with Trademarks and Paten=
ts and finally Industrial Designs too.

The Office's databases are provided by mutual exchange of patent documen=
tation with other Offices. There is CD-ROM collection of: European Patent A=
pplications, PCT international Application (WORLD), JOPAL, ACCESS, LEGAL an=
d the Bulletin all from the ESPACE production, and than Patent Abstracts Of=
Japan (PAJ CD-ROM), USAPAT, Collection of Republic of Moldova, PRECES, HUN=
PAT=C3=89KA and Slovenian Patent Documents on CD ROM. The Office has been r=
eceiving the said patent documentation, continuously.
The official gazette =E2=80=9CGlasnik=E2=80=9D issued by The Office as wel=
l as The Annual Rapport are delivered to the following countries: YU, HR, S=
I, BG, CZ, PL, SE, TR, AT, AL, BY, BE, KR, FR, HU, CH, UA, ER, GB, US, JP, =
PT, KP, RU, SK, ES, MD and FI. The Office receives gazettes and annual rapp=
ort from the next countries: AT, BG, ER, BY, MD, PL, HU, UA, FI, CZ, RU, SK=
, JP, YU, HR and SI. These documents are on the paper, mostly.
State Office of industrial property of the Republic of Macedonia organiz=
es seminars in purpose of nourishing a process of continuous innovation of =
knowledge of the employees and other subjects involved in the development o=
f this area.
On the 18th and 19th of March this Office with the World Intellectual Prop=
erty Organization (WIPO) organized the national seminar on the Patent Coope=
ration Treaty (PCT) in Skopje which integrated the overall PCT procedure an=
d specific things that stem from the full implementation of the Agreement. =
From the 3rd to the 5th of June this Office and the European Patent Office=
organized seminar entitled =E2=80=9CMacedonian Practice and the European P=
atent System=E2=80=9D which included whole procedure for registration of Eu=
ropean Patent.
Within the framework of the regional CARDS program (Community Assistance f=
or Reconstruction, Development and Stabilization) of European commission a =
number of introductionary seminars were included for the promotion of the p=
rogram and targets of this project.
As part of the international cooperation, and particularly International P=
atent classification representatives from this Office have attended couple =
of sessions organized on different subject matters as formation of a Master=
Classification Database, considering of new key words and official indices=
on the 8th edition of the IPC(International Patent Classification), specif=
ic problems relating to chemistry and illustration of chemical formulas in =
the electronic sphere.
WIPO Academy organized seminars on industrial property where representativ=
es from the Office were introduced with experience of other Offices for pro=
tection of industrial property rights.
Office representatives pay special attention to bilateral activities, and =
great numbers of contacts of this kind have been made during the year 2003.=
Inventors from the Republic of Macedonia traditionally presented their inv=
entions at the 52th International Exhibit of Inventions, Researches and New=
Technologies =E2=80=9CBrussels Eureka 2003=E2=80=9D in Brussels. The State=
Office of Industrial Property and the Association of Inventors and Authors=
of Technical Advances organized the presentation of the inventors.
The celebration of the 10th anniversary of the existence and operation of =
the State Office of Industrial Property was enriched by awarding of the Pat=
ent of the Year Award 2003. The World Organization for Intellectual Propert=
y gave the awards for =E2=80=9CBest Invention=E2=80=9D, =E2=80=9CWoman Inve=
ntor=E2=80=9D and =E2=80=9CYoungest Inventor=E2=80=9D. Many guests from Mac=
edonia and abroad attended this manifestation on which were mentioned histo=
rical overview of the achieved results, experiences and attainments of the =
Office cooperated with other institutions.
From the 10th to the 12th of November the European patent Office, the Euro=
pean Commission and the Ministry of Economy of Luxemburg organized annual c=
onference of EPIDOS 2003 and the international exhibit PATINOVA where parti=
cipants presented the experiences from their respective field of work.
