I. Evolution of registration activities

In 2012, the highest percentage of applications was filed according to the following classes of the Nice Classification:
Class 35 “Advertising; business management; business administration; office functions” (17.1%);
Class 05 “Pharmaceutical and veterinary preparations; sanitary preparations for medical purposes; dietetic food and substances adapted for medical or veterinary use, food for babies; dietary supplements for humans and animals; plasters, materials for dressings; material for stopping teeth, dental wax; disinfectants; preparations for destroying vermin; fungicides, herbicides(7.8%);
Class 41 “Education; providing of training; entertainment; sporting and cultural activities” (6.1%);
Class 33 “Alcoholic beverages (except beers)” (5.6%);
Class 30 “Coffee, tea, cocoa and artificial coffee; rice; tapioca and sago; flour and preparations made from cereals; bread, pastry and confectionery; ices; sugar, honey, treacle; yeast, baking-powder; salt; mustard; vinegar, sauces (condiments); spices; ice” (4.9%);
Class 09 “Scientific, nautical, surveying, photographic, cinematographic, optical, weighing, measuring, signalling, checking (supervision), life-saving and teaching apparatus and instruments; apparatus and instruments for conducting, switching, transforming, accumulating, regulating or controlling electricity; apparatus for recording, transmission or reproduction of sound or images; magnetic data carriers, recording discs; compact discs, DVDs and other digital recording media; mechanisms for coin-operated apparatus; cash registers, calculating machines, data processing equipment, computers; computer software; fire-extinguishing apparatus (3.5%).

Information concerning marks for goods and services is published in the Official Bulletin “Promyslova Vlasnist” (“Industrial Property”) in the following sections of its Book 2: “Information about the Issue of Certificates of Ukraine for Marks for Goods and Services”, “Information about Well-Known Marks in Ukraine”, “Information about the Marks Registered According to the Madrid Agreement on the International Registration of Marks and/or the Protocol to the Madrid Agreement on the International Registration of Marks which were Granted Protection in Ukraine”, in the Indexes to each section and the “Notifications” section. Colour Representation is published in section “Colour Representations of Marks for Goods and Services” if available.
Like in the previous year, the Official Bulletin “Promyslova Vlasnist” was issued both on paper and electronic (DVD) carriers twice a month – during 2012 24 issues of the Bulletin were published. The Annual Index to the paper edition of the Official Bulletin for the previous year, 2011, was also published.
Besides, the following publications were issued:
- twice a month – CD-ROM “Marks for Goods and Services Registered in Ukraine”. It contains bibliographic data, images of marks, lists of goods and services, specified according to the International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification);
- a cumulative retrospective optical DVD-disc “Marks for Goods and Services Registered in Ukraine”. It contains information about all registrations of Marks for Goods and Services recorded in Ukraine since January 1993 up to the completion of the current registration.
The quarterly review “Industrial Property in Figures. The basic indicators of the activities of the State Intellectual Property Service of Ukraine and the State Enterprise “Ukrainian Industrial Property Institute” was also published. Its publication, starting from the 2nd half of 2012, was carried out in electronic form exclusively at the web-portal of the State Intellectual Property Service of Ukraine (State Service) and web-site of the State Enterprise “Ukrainian Industrial Property Institute” (UIPI).

Main types of announcements of the Office in the field of trademark information

The automated workplace of the editorial Department is used for formation of the information arrays, which are included to the Official Bulletin “Promyslova Vlasnist”. The prepared layout of the publication is forwarded to the printing office for replication.
Special software was used for preparation of the data arrays and their recording on optical discs.
Project documentation and software export information, concerning the section “Notification” of the official Bulletin “Industrial property”, was developed in XML format. A prototype XML-data and formal structure (schema of an XML document), specification of the rules for formation and presentation of information, the structure and amount of data to export information were developed within the project.
Data generation for updating corresponding DBs on the Internet is carried out by means of the “Marks for Goods and Services” AS software.

Processing of applications for trademarks is carried out by means of the “Marks for Goods and Services” AS, which functions in the local computer network (LAN) environment.
The “Marks for Goods and Services” AS functions in the environment of the local computer network (LAN). The software of the automated system is designed according to the Client-Server technology.
The following server operating systems are used: Microsoft Windows Server 2008R2, 2008, 2003.
In 2012, two new severs were implemented into operation (HP DL 380 G7). The virtualization technology on virtualization platforms Hiper-V and VMware was implemented on their bases
The data storage network SAN was implemented. The information store (HP P2000, HP MSA2324fc, HP MSA1000, Infortrend S16F-R1430, Infortrend S12F-R1420, Infortrend A16F-G2430, IBM ProFibre Storage Array DL1100R) are used for data backup.
Up-to-date personal computers with the operating system Windows XP Professional and Windows 7 are used as workstations

VI. Administration of trademark information products and services available to the public (relating to facilities, e.g., for lodging applications, registering trademarks, assisting clients with search procedures, obtaining official publications and registry extracts)

During 2012 the PPDC was currently updated by a national and foreign patent documentation, first of all on optical discs. As on 29.12.2012, the PPDC numbered over 20.5 thousand copies of official bulletins.
In the PPDC the users had access to information about trademarks published in the Official Bulletin “Promyslova Vlasnist” (Book 2) and the Official Bulletins of 43 foreign offices and WIPO.
Information about the content of the PPDC and its quarterly updates was published in the “Information Resources” section at the web-portal of the State Service (http://www.sips.gov.ua), the web-sites of the UIPI (http://www.uipv.org) and the Branch (http://www.ip-centr.kiev.ua).
The PPDC is located in the premises of the Branch in three specially adapted and equipped offices (two stores with a total area of 81 sq. m. and a reading room of 40 sq. m. in area).
Proper storage of the PPDC documents meeting specified requirements and guaranteeing their safety was ensured.
In particular, visual control of an access of unauthorized persons to the PPDC premises was carried out constantly, that made their access to the documents repositories impossible, and the documents were provided to the users solely in the reading room. Modern technologies for ensuring protection of library collections from theft and damage (video surveillance) were also used.
