Annual Technical Report 2012 on Industrial Design Information Activities submitted by Brazil (CWS/ATR/ID/2012/BR)

The expression "industrial designs" covers industrial designs and models. Offices which issue design patents should report their design patent information activities in this series of Annual Technical Reports.

I. Evolution of registration activities

Changes experienced in terms of application filings and grants (registrations) with respect to the previous year

Applications for national BR industrial designs increased from 6.985 in 2011 to 6.772 in 2012 (-3,05%). Grants (registrations) decreased from 4.646 in 2011 to 4.334 in 2012 (-7,7%).

II. Matters concerning the generation, reproduction, and distribution of industrial design documents and of secondary sources of industrial design information, i.e., official gazettes

(1)Paper Industrial Design Documents
INPI has a paper collection of BR industrial designs with approximately 85,000 documents, published between 1924 and 1973, classified according to a National Industrial Design Classification.
The paper collection is not available for searches, however paper copies of entire documents can be provided for internal or external demands.

(2) Industrial Property Gazette
Official notices and selected bibliographic data relating to BR industrial design applications and registrations are internally generated and published in the official weekly electronic Brazilian Official Gazette (Revista da Propriedade Industrial - RPI). The gazettes are available on the Brazilian Patent Office website in PDF and TXT format, at http://revistas.inpi.gov.br/rpi, and all the published official gazettes are stored in the library and are available to the public.

(3) Internet
Bibliographic data of Brazilian Industrial Design is available for consultation at an internal database (SINPI) and at internet (http://pesquisa.inpi.gov.br/MarcaPatente/jsp/servimg/servimg.jsp?BasePesquisa=Desenhos). Keyword searches in titles are available only in Portuguese. Brazilian patent documents’ first pages contain bibliographic data, according to WIPO standards.

Main types of announcements of the Office in the field of industrial design information

INPI's website (www.inpi.gov.br) plays an increasingly important part in the dissemination of notices regarding to industrial designs, as well as it informs the public and the community of users all the information concerning training activities, events and legal information concerning intellectual property.

The official gazette weekly provides users the information concerning INPI's decisions on industrial designs matters

Mass storage media and microforms used

All Brazilian documents of industrial designs, filed since 1974, have been digitized and can be accessed through internal electronic procedures.

Databases and office automation

Search tools are available to technical staff and technical personnel performing industrial design information activities to external users. There is a corporate database (Integrated System of Industrial Property - SINPI) for processing the life of a BR industrial design application, where searches can also be performed. The Office's intranet contains a large collection of useful information for the INPI staff.

Copies of the documents cited in the search reports are produced in-house to supply the applicants.

All staff accesses the Internet and the Office’s intranet and have their own official e-mail addresses. The Office uses Microsoft Windows XP; 7 and BROffice open source software, which provides an integrated and extensive network of applications that are available to all staff. All personnel have their own workstation on which numerous applications are available. Word processing can be carried out using Microsoft Word and BROffice Writer; PowerPoint, Excel, BROffice Impress and BROffice Calc are also available.

III. Matters concerning classifying, reclassifying and indexing of industrial design information according to the classification systems applied

Industrial Design documents are classified by INPI staff according to Locarno Classification.
If necessary, some documents are reclassified.

Bibliographic data are used for search using the internal system (SINPI) and through Internet (http://formulario.inpi.gov.br/MarcaPatente/jsp/servimg/servimg.jsp?BasePesquisa=Desenhos).

IV. Search file establishment and upkeep

File building

File building and updating of search file, classified under the Locarno Classification is centralized. BR industrial design documents collection is arranged according to Locarno Classification (9ª Edition) and is available in paper.
In 2012 the collection of industrial design documents increased 5.201 paper documents.

Updating

Administrative staff carries out updating of the search file centrally.

V. Activities in the field of computerized search systems for industrial designs

In-house systems (online/offline)

The SINPI database (Integrated System of Industrial Property) is the in-house system available for searching. Technical searching can be carried out using Locarno Classification code or indexing terms, combinations of terms from the same or different headings for searching industrial design documents, legal status or other parameters. External databases

In order to carry out searches in industrial design documents or other publications, the INPI staff access a number of Internet free industrial design databases. Official policy is that a worldwide online search should be carried out as whole or part of every industrial design search or substantive examination (assessing novelty and originality after the grant) done in this Office.

Planning, administration, automation, security

INPI has an internal library that is conducted by the Center of Dissemination of Technological Information (CEDIN). Library collection contains technical books, pamphlets, manuals, some legal reports, name and subject-matter indexing books, periodicals and official gazettes from many different countries. The collection is located in the office’s main building in a secure manner, and the consultation can be done via intranet (INPI staff) or locally (INPI staff and external users).

The Center for the Dissemination of Technological Information (CEDIN) is in charge of maintaining the library

The Office's Search and Advisory Service continues to promote its activities in providing priced industrial design investigations.

Promotional activities (seminars, exhibitions, visits, advertising, etc.)

INPI continued to promote, in 2012, its presence at many exhibitions and seminars, and conducted visitors to the Office.

Training courses for national and foreign participants

In accordance with the Brazilian Innovation Law, INPI has begun an extensive training program, including seminars and courses, aiming to prepare managers and technicians staff in different aspects of intellectual property. Managers and technicians from Universities, Institutions of Research and Development, Secretaries of Science and Technology and institutions supporting small and medium-sized enterprises were trained.

Assistance to developing countries (sending consultants and experts, receiving trainees from developing countries, etc.)

INPI delivers seminars and workshops and working meetings including developing countries. By the means of a WIPO-INPI Cooperation Agreement, six events about subjects and themes that concerns developing countries took place, which involved around 45 experts from developing countries.

A cooperation project among IP offices in the South American continent is growing in importance and can be access at: http://www.prosur.org.ar.

X. Other relevant matters

All Brazilian documents of industrial designs, filed since 1974, have been digitized and can be accessed through internal electronic procedures.
Several actions were taken in 2012 in order to improve the procedures related to industrial design’s registrations as well as to offer the users an easier way to obtain the related information.
