The main types of trademark information activities include support of examination of trademark applications, in particular, forming of search databases for internal use at the Office, performance of searches, publication of information on trademark applications, information on the issuance of certificates of Ukraine for trademarks in the Official Electronic Bulletin “Industrial Property”, as well as the creation of interactive databases and information and reference systems for providing information services to a wide range of users via the Internet.

Examination of applications for trademarks has full functionality of the text processing and prosecution of trademark applications at all stages, from application filing to completing the examination and maintenance of the State Register of Certificates of Ukraine for Trademarks.

An automated worksite of the Editorial Department was used to form the information arrays which are included to the publications in the Official Electronic Bulletin "Industrial Property".

The following resources were introduced for information support of the trademark applications examination procedure:

  • the International Classification of Goods and Services for the Purposes of the Registration of Marks, Twelfth Edition, version 2023 (NCL (12-2023)) translated into Ukrainian;

-      Statistics: changes in terms of application filings and registrations with respect to previous year; trends or areas experiencing rapid changes

Applications filed:

in 2022 – 16,234, in 2023 – 25,232, increased by 55.4%, as compared to the previous year.

In 2023, a total of 22,238 trademark applications were received under the national procedure through the electronic filing system for industrial property rights (88.1% of the total number of trademark applications filed under the national procedure), increased by 102.4%, as compared to 2022 (10,989 applications).

In 2023, as compared to the previous year, the following areas experienced rapid changes: «Transportation and logistics» (+66.4%), «Textile products, clothing and accessories» (+52.0%), «Home equipment» (+62.0%), «Agricultural products and services» (+46.9%), «Scientific research, information and telecommunication technologies» (+35.6%).

Registered Certificates:

in 2022 – 16,029, in 2023 – 14,530, decreased by 9.4%, as compared to the previous year.

Applicants from the USA and Cyprus (392 applications each, or 14.2%), Switzerland (300 applications, or 10.8%), the United Kingdom (237, or 8.6%), China (185, or 6.7%), Germany (147, or 5.3%), Poland (141, or 5.1%), Estonia (71, or 2.6%), Japan (59, or 2.1%), India (47, or 1.7%), the Republic of Korea (45, or 1.6%), Hong Kong, China (43, or 1.5%), France and Singapore (39 applications each, or 1.4%) were the top non-resident applicants, who filed under the national procedure.

In 2023, a total of 5,566 international applications were received from the International Bureau of WIPO. Under international registration procedure, a total of 6,911 trademarks were granted protection.

In the course of the year, a total of 465 resident trademark applications for international registration were received by WIPO.

II. SERVICES AND ACTIVITIES RELATED TO TRADEMARK INFORMATION CARRIED OUT BY THE OFFICE

Information for users on various procedures and sources of information on trademarks, in particular, information on the legislation in the sphere of trademarks, Office’s services and activities related to the information on trademarks, statistical information, etc. are published on the website of the Office.

The applicants may file the applications for trademarks on paper as well as electronically.

Electronic filing of applications is performed through the Electronic Applications Filing System (EAFS-1). The applicant's personal account was implemented in the system providing access to all documents generated in the process of interaction between the Office and applicants during prosecution of trademark applications.

Electronic applications filing and electronic exchange between the Office and applicants may also be carried out by means of the Electronic Interaction System (EIS).

Clarifications regarding the work with systems, rules of drafting an application, user manuals and regulatory documents are available on the Office website.

-      Availability of the application dossier in electronic form

All application materials for trademarks (both primary and secondary), irrespective of the way they are filed to the Office (through the electronic filing system, on paper carriers, by email, fax or other telecommunication networks), are uploaded and stored in the electronic document archive automatically or after being scanned. In order to use the application materials in the course of prosecution of applications, the technological automated systems have been integrated with the electronic archive of documents.

Classification and reclassification activities; classification systems used, e.g., International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification), International Classification of the Figurative Elements of Marks (Vienna Classification), other classifications

In the course of examination of applications, the conformity of the declared goods and services with the relevant classes of the Nice Classification is checked.

As of January 1, 2023, the 12th edition of the International Classification of Goods and Services for the Purposes of the Registration of Marks (NCL (12-2023)) translated into Ukrainian was implemented.

The IRS «International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification)» has implemented the option of accessing the full range of materials of the NCL data in Ukrainian translation for versions from NCL (10-2014) to NCL (11-2022). Additionally, the Previous Versions option has been implemented for data that existed over the period of validity of relevant versions/editions of the Nice Classification. Thus, the access to the IRSs that were created for the NCL (9), the NCL (9) (second, amended, edition), the NCL (10) and the NCL (10-2013) is provided. The NCL (7) and the NCL (8), which were published only in hard copy, are available as PDF files.

The International Classification of the Figurative Elements of Marks (Vienna Classification) IRS for VCL (9) was used for drafting and prosecution of applications. The above-mentioned IRS also provides an option to access the full set of VCL in Ukrainian translation. The materials are available in the form as they existed over the period of validity of relevant versions/editions of the VCL, including VCL (8), VCL (7) and VCL (6) of the classification.

              In 2023, the following electronic classification systems were used:

-    the NCL (12-2023) and the VCL (9) translated into Ukrainian – for trademark applications examination;

-    the IRS « International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification)» for the NCL (12-2023) and the IRS «International Classification of the Figurative Elements of Marks» (Vienna Classification) for the VCL (9) – by a wide range of users, primarily applicants (available for free on the website of the Office).

The comprehensive automated record keeping system for applications for designations and industrial designs (CARKS ADID) provides for processing of applications for colour, sound and three-dimensional marks.

  • SIS provides access via the Internet to information on any industrial/intellectual property right (hereinafter referred to as IPR/IP) in the mode as close to real-time as possible. The search engine of the system with its universal search interface, provides open and authorized access to any document of the electronic dossier. Two search engines are implemented in the SIS - simple and advanced. The advanced search has additional search tools, which can be used to limit the search by type of IPR and legal status. Depending on the IPR type and legal status, any search parameter can be selected.

IV. ICT SUPPORT TO SERVICES AND ACTIVITIES RELATED TO TRADEMARK INFORMATION CARRIED OUT BY THE OFFICE

Information on the following topics is desired:

-      Specific software tools supporting business procedures within the Office: general description, characteristics, advantages, possible improvements

The main tool for examining trademark applications and maintaining state registers is the Comprehensive Automated Record Keeping System for Applications for Designations and Industrial Designs (CARKS ADID). The whole cycle of the formation, approval, signing, transmission and registration of documents is carried out on the basis of the electronic technology. The integrated search engine enables to search for similar trademarks in the arrays of national and international applications and registrations, well-known trademarks, etc.

-      Hardware used to supporting business processes of the Office

The server part is based on x86 platform servers manufactured by Hewlett-Packard Enterprise (HPE) (HPE Synergy 480 Gen10, DL380Gen10, DL380Gen8).

           Information storage models are:

           HPE (3Par StoreServ 8400, 3Par StoreServ 7200, MSA2050, MSA2040).

           The Storage Area Network (SAN) is based on HPE SN3000B switches.

           The general network infrastructure is based on:

  • a two-device Fortinet FG-600F cluster containing VPN and Firewall modules for Internet connectivity, which provides access control to Internet sites and protects the Department's IT infrastructure from complex threats and malicious attacks (botnets, targeted attacks, APT and zero-day attacks);
  • FortiMail-VM virtual appliance for protecting email servers;
  • an internal router (built on a Unix server) to support the local computer network of the Office.

           The local computer network includes a set of HPE Aruba 8320, HPE Aruba 2930M, HPE Aruba 2540-48, HP 2530-48, HP 2510-48 switches and is divided into fifty virtual networks (Vlan).

           The server infrastructure is fully virtualised. The physical servers run Microsoft Hyper-V Server 2019 and VMware ESXi, which allow to create and operate the productive virtual servers. The virtualization servers are grouped into Hyper-V clusters, which allow for high availability of productive servers running Microsoft Windows Server 2019, Microsoft Windows Server 2016, Microsoft Windows Server 2012R2, Microsoft Windows Server 2012, Microsoft Windows Server 2008R2 and CentOS 7.

           The database management systems used are MS SQL Server 2017, MS SQL Server 2016, MS SQL Server 2014, MS SQL 2008R2, MS SQL 2005, PostgreeSQL, MySQL.

           The Active Directory (AD) domain structure is designed to allow the centralized management of all information resources, including users, computers, files, peripherals, access to services, network resources, websites, databases, etc.

           Several domain controllers are used to organize the fault tolerance of the domain structure.

           The WSUS server provides updates to the operating systems of servers and client computers.

           The ESET Antivirus Server provides centralized management of all anti-virus programs on users’ computers, updates antivirus databases, and generates reports on database updates and existing threats.

           Data is backed up using Veeam's Veeam Backup & Replication software product, which provides continuous data protection for reliable recovery of Windows servers. There is a disaster recovery plan for all servers and services.

           Other Microsoft System Center 2019 products are also used, namely: Virtual Machine Manager (SCVMM) for virtualization management, System Center Configuration Manager (SCCM) 2012R2 for operating system installation and software configuration.

           The measures taken to develop the IT infrastructure in the current period were aimed at building the fail-safe core of the computer network, increasing its bandwidth, security and manageability, replacing outdated hardware components of the infrastructure, consolidating and virtualizing servers. Virtualization servers are clustered to ensure high availability of all systems.

In total, the corporate network consists of 676 personal computers, 24 physical and 122 virtual servers, 6 data storages and various switching equipment.

For the information systems users the Internet connection is provided to search and browse information.

-      Internal databases: coverage, updates, interlinks with external sources

The data from a number of sources (internal and external) are used while carrying out examination of applications for trademarks:

  • Comprehensive automated system of record keeping for applications for designations and industrial designs submitted under the procedure of national registration in accordance with the national legislation of Ukraine and/or in accordance with international treaties under the procedure of international registration (10.10.23.1);
  • International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification). The current version of the current edition (https://nice.nipo.gov.ua/);
  • International Classification of the Figurative Elements of Marks (Vienna Classification) (https://base.uipv.org/vienna/);
  • The Ukrainian Classification of Goods for Foreign Economic Activity (UCGFEA), which is an annex to the Law of Ukraine "On the Customs Tariff of Ukraine", dated October 19, 2022 № 2697-IX;

The internal electronic resources are updated during prosecution of applications and maintenance of the relevant state registers.

-      Establishment and maintenance of electronic search file: file building, updating, storage, documents from other Offices included in the search file

The electronic search collection is located on the internal information resource called the Search Portal. The data at the Portal are updated regularly as patent documentation of foreign patent offices is received on optical carriers or uploaded from corresponding FTP-servers.

CARKS ADID is used to review applications for registration and maintain the State Register of Ukraine for Trademarks.

CARKS ADID includes a database (DB), which stores data on cases concerning the examination of trademark application materials and cases related to the state registration of trademarks. The DB also contains reference books and metadata of cases and documents. The documents themselves are stored in a special file repository, and the DB contains references to the location of the document.

According to the regulations, CARKS ADID interacts with the WIPO International Bureau to receive a notification of a new application for international registration with extension to the territory of Ukraine, which contains bibliographic data, a trademark image and a number of input documents. After the applications are distributed to examiners, they are processed. Based on the conclusions of the examination, a decision is made regarding the granting or refusal of legal protection on the territory of Ukraine, etc.

-      Administrative management electronic systems (register, legal status, statistics, and administrative support)

Information concerning the legal status of registered trademark certificates of Ukraine to the extent provided for by the relevant Law of Ukraine was published in the «Notices» section of the Official Electronic Bulletin «Industrial Property». The information in this section is presented in PDF format in the form of a periodical.

However, such information is available in the SIS. The SIS provides a «Search by Notices» mode, which allows users to find information on IPR for which notifications of a given type have been published in the Official Electronic Bulletin «Industrial Property» within a specified period of time.

The administrative management functions are implemented in Designations AS using separate software subsystems and modules.

Thus, to maintain the registers and legal status of titles of protection trademarks, multifunction subsystems are operative within the automated system. The information from this system is forwarded to relevant databases for publication and for drawing statistic reports.

The Indicators AS is characterized by the capability to form multiple reports and implementation of a mechanism of calculation of indicators by objects which have multiple details for all IP rights. The Indicators AS is built on a modular basis and provides automation of data loading, preparation of data arrays, and drawing of statistic reports.

The Indicators AS has the ability to expand the list of indicators. The function of an automated analysis of estimated data was implemented. The Indicators AS subsystem provides for the possibility of entering data on the main economic indicators of the state's development and other external factors.

The website of the Office provides free access to information on trademarks published in monthly reports, Annual Reports, Annual Technical Reports of the Trademark Information Activities of the Office, quarterly issues of the online publication "Intellectual Property in Figures" (statistical information).

V. PROMOTION ACTIVITIES AIMED TO SUPPORT USERS IN ACCESS AND EFFICIENT USE OF TRADEMARK INFORMATION

-      Office's library (if deals with trademark information): equipment, collection management, network of libraries in the country, cooperation with foreign libraries

In 2023, in order to ensure access of the general public to patent documentation and non-patent literature in the process of creation, legal protection and use of IPR, the following lists were updated on a quarterly basis: «The List of IPR Databases of Foreign Patent Offices, to Which Free Access is Provided on the Internet», which provides links to the databases of 54 patent offices of the world and 4 international and regional intellectual property organizations; «The List of Scientific and Technical Databases and Reference Resources, Free Access to Which is Provided on the Internet»; «The List of Publicly Available Information Resources of Patent Documentation», posted on the website of the Office in the section «For Users of Patent Information».

In order to satisfy public needs for patent information in Ukraine, that is necessary for study and analysis in the process of creation, legal and use of IPRs, work was carried out to restore the functioning of the Public Patent Documentation Collection (PPDC).

The main source of acquisition of foreign patent documentation by the PPDC has long been the international exchange of patent documentation with foreign offices. Such international cooperation allowed the Office to accumulate significant funds of current as well as retrospective patent documents.

-      Publications related to different business procedures and trademarks sources available to users, for example, books, brochures, Internet publications, etc.

The Office`s website provides free access to information on trademarks published in the Annual Reports, Annual Technical Reports of the Office on Trademark Information Activities, quarterly issues of the Booklet «Intellectual Property in Figures» (statistical information).

In order to provide information support to the development and functioning of the Office, in particular, to improve the Ukrainian patent and terminology base, standardization and unification of terminology in the intellectual property sphere, the Office carries out translation of the WIPO Standards into Ukrainian, primarily those that have more practical value and relate to various IPR types, and ensures their timely updating.

In total, twenty-nine WIPO Standards have been translated (with no official status) and are available on the Office website in WIPO Standards section.

-      Cooperation with universities, technology and innovation support centers, etc.

The Technology and Innovation Support Centre (TISC) is an international project to support inventions, innovations and start-up projects launched by WIPO, implemented in Ukraine by the Ministry of Economy of Ukraine and the Office.

Regional TISCs are established through the signing of a Memorandum of Cooperation and an Agreement on the establishment and further functioning of the TISCs.

Project implementation:

As of the end of 2023, 30 TISCs are functioning in Ukraine including the TISC Head Office and 16 TISCs opened in 2023 in 8 regions and Kyiv.

In 2023, the TISC Head Office provided 22 consultations on the development of innovation activities, creation of innovative projects, commercialization of IPRs, and technology transfer.

In 2023, according to the monitoring of the TISC Head Office, the regional TISCs of Ukraine responded to user requests, including: assistance in using the WIPO ARDI and ASPI databases - 23; provision of general information on legislation in the field of innovation and intellectual property - 300.

The specialists of the Office (outside the TISC project activities in Ukraine) provided 479 consultations on applications for IPRs: inventions and utility models; industrial designs; trademarks.

The TISC Head Office provided 8 consultations and methodological support to the TISC network members on the connection and use of the WIPO ASPI and ARDI databases.

In 2023, the specialists of the Office participated in specialized and educational events in the field of intellectual property, organized by both the Office and other international organizations, including WIPO, EPO, EUIPO, etc.

VI. INTERNATIONAL COOPERATION ACTIVITIES IN THE FIELD OF TRADEMARK INFORMATION

Information on the following topics is desired:

-      International exchange of trademark information in machine-readable form (e.g., official gazettes)

The international exchange of patent documentation is carried out by the Office, which was recognized in 2003 as the Centre for International Exchange of Publications in accordance with the Convention on the International Exchange of Publications adopted on December 3, 1958 by the UN General Conference on Education, Science and Culture.

In 2023, in the framework of international exchange, the Office continued the transition to free international exchange of patent documentation on intangible media, namely by providing access via the Internet thereto and spreading data exchange, mainly through the office's FTP servers.

In 2023, the Office continued international cooperation in the field of intellectual property with WIPO, the EPO and intellectual property offices of other countries.

Representatives of the Office participated in the work of WIPO Task Forces (including online), preparation of relevant proposals and information on Ukraine (if necessary) at sessions and meetings of WIPO Committees and Working Groups (online), in particular, in the work of the Task Forces (TF) of the Committee on WIPO Standards (CWS) on the development of new WIPO Standards, their updates, as well as other CWS projects:

VII. OTHER RELATED MATTERS

The Quality Management System (hereinafter referred to as the QMS) has been introduced and is being applied at UANIPIO in accordance with the requirements of ISO 9001:2015 international standard.

In June 2023, a representative of the international certification body DEKRA (DEKRA Certification GmbH) conducted a verification (certification audit) of the compliance of the QMS of UANIPIO with the requirements of ISO 9001:2015. According to the results of the audit, the QMS of UANIPIO meets the requirements of ISO 9001:2015. Audit report No. Z-A 677423/GC/9001. Certificate registration number 32072300505 (DEKRA Certification Sp. z o.o. Wrocław; 04-07-2023).

The certificate of conformity is valid until July 3, 2026.

Compliance with the requirements of the international standard ISO 9001:2015 is ensured at UANIPIO. There are 16 QMS processes in operation at UANIPIO, the sequence and interaction of these processes, performance criteria and means of managing these processes, as well as monitoring of QMS processes and service quality at all relevant stages of the QMS processes are defined. To ensure internal communications on quality issues and coordination of activities affecting quality, UANIPIO established a Coordination Council for the development, implementation and maintenance of the QMS, as well as appointed a Chief Commissioner for the implementation and maintenance of the QMS.

The Quality Policy is defined and approved by Order of the UANIPIO No. 96 dated May17, 2023.

The Coordination Council shall meet at least once every six months. In 2023, 3 (three) meetings of the Coordination Council were held.
