I. Evolution of patent activities

Changes experienced in terms of application filings and grants with respect to the previous year

Statistical evolution concerning:

in 2011– 5,249, in 2012 – 4,955, i.e. 5.6% decrease with respect to the previous year.

Patents granted:
in 2011– 4,061, in 2012 – 3,405, i.e. 16.15% decrease with respect to the previous year.

From 01.02.2012 to 30.12.2012 within the framework of experimental tests of electronic filing system for Industrial Property Objects (IPOs) 143 applications for inventions were received.

Utility models

Applications filed:
in 2011– 10,436, in 2012 – 10,217, i.e. 2.1% decrease with respect to the previous year.
Patents granted:
in 2011 – 10,291, in 2012 – 9,951, i.e. 3.3% decrease with respect to the previous year.

From 01.02.2012 to 30.12.2012 within the framework of experimental tests of electronic filing system for IPOs 159 applications for utility models were received.

Trends or areas experiencing rapid changes with respect to the previous year

In 2012, the highest percentage of filed applications was in the following technical areas: “Medical or veterinary science; hygiene” – IPC Class A61 (11.3%); “Organic chemistry” – IPC Class C07 (10.5%); “Agriculture, forestry, animal husbandry…” – IPC Class A01 (6.6%); “Measuring, testing” – IPC class G01 (4.1%).

II. Matters concerning the generation, reproduction, distribution and use of primary and secondary sources of patent information

Publishing, printing, copying (main types of publications of the Office in the field of patent information, etc.)

Information concerning patents and utility models is published in the following official publications of the State Intellectual Property Service of Ukraine (State Service): the Official Bulletin “Promyslova Vlasnist” (“Industrial Property”) and patent and utility model specifications.
Like in the previous year, the Official Bulletin “Promyslova Vlasnist” was issued both on paper and electronic (DVD) carriers twice a month – during 2012 24 issues of the Bulletin were published. The Annual Index to the paper edition of the Official Bulletin for the previous year, 2011, was also published.
The patent (utility model) specifications of Ukraine on electronic carriers – CD-ROM “Inventions in Ukraine” – were issued with the same frequency. 13,356 patent specifications of Ukraine (3,405 for invention, 9,951 for utility model) were published during the reporting period.
Taking into consideration the international practice on publication of national patent documentation on electronic carriers, publication of specifications to patents of Ukraine for inventions and utility models on paper carrier was ceased as from 2012.
The quarterly review “Industrial Property in Figures. The basic indicators of the activities of the State Intellectual Property Service of Ukraine and the State Enterprise “Ukrainian Industrial Property Institute” was also published. Its publication, starting from the 2nd half of 2012, was carried out in electronic form exclusively at the web-portal of the State Service and web-site of the State Enterprise “Ukrainian Industrial Property Institute” (UIPI).

Main types of announcements of the Office in the field of patent information

Information concerning inventions and utility models is published in Book 1 of the Official Bulletin “Promyslova Vlasnist” in the following sections: “Information about Invention Applications Accepted for Examination”, “Information on the Grant of Patents of Ukraine for Inventions”, “Information on the Grant of Patents of Ukraine for Utility Models”, in the Indexes to each section and in the “Notifications” section”.
Printed publications of the Official Bulletin “Promyslova Vlasnist” contain:
for Section “Information about Invention Applications Accepted for Examination” – bibliographic data;
for Section “Information on the Grant of Patents of Ukraine for Inventions”, “Information on the Grant of Patents of Ukraine for Utility Models” – bibliographic data and claims.
Publications in electronic information resources contain:
for DB “Electronic Version of the Cumulative Official Bulletin “Promyslova Vlasnist” – information concerning inventions and utility models is published in the same scope as in printed edition. Moreover, information concerning legal status of the patents is provided in the sections “Information on the Grant of Patents of Ukraine for Inventions”, “Information on the Grant of Patents of Ukraine for Utility Models”;
for Specialized DB “Inventions (Utility Models) in Ukraine” – bibliographic data, claims, abstracts, specifications and information concerning legal status of the patents.

Mass storage media used (paper, microforms, optical storage, etc.)

Mass storage media for information about inventions and utility models in the UIPI are paper carries, servers of electronic databases, Storage Area Network disc data storage systems, optical discs DVDs.
Special software is used for data file preparing and writing it on optical discs.
CD-ROM “Invention in Ukraine” is formed with use of the EPO mixed mode authoring software MIMOSA.

Word processing and office automation

Incoming documents flow on paper carriers is processed by the system of current scanning and recognition of text documents based on the ABBYY Recognition Server 3.0. Digitized documents of applications are accumulated in "electronic dossiers" of applications and stored in the Central electronic documents archive (CEDA). The CEDA is integrated with all technological automated systems.
Processing of applications for inventions is carried out by means of the “Inventions” AS software. The whole cycle of documents generation, endorsing, signing, transfer and registration is based on electronic technology.
Details of incoming documents on which an identification of the object to which the incoming document relates is carried out, are automatically defined in the medium of the “Inventions” AS.
The automated functions for applications for inventions and utility models processing control, selecting of applications for inventions and utility models, administration of users within the Divisions of Examination of Applications for Inventions, Utility Models and Integrated Circuits Topographies were realized in the "Inventions" AS.
In 2012, experimental tests of electronic application filing system for IPOs were continued, including for invention (utility models). Filing of applications and exchange of documents between the applicants and examination body is carried out by means of the system in electronic format. The total number of its users increased in 2012 by 30% with respect to the previous year.

(New) techniques used for the generation of patent information (printing, recording, photocomposing, Optical Character Recognition (OCR), etc.)

Forming of the publication sections of the Official Bulletin “Promyslova Vlasnist” is carried out automatically by means of the “Inventions” AS software. The prepared layout of the publication is forwarded to the printing office for its replication.

III. Matters concerning abstracting, classifying, reclassifying and indexing of technical information contained in patent documents

Abstracting, reviewing, translating

Abstracts and bibliographic data are formed routinely in three languages (Ukrainian, Russian and English) for publication in the national CD-ROM “Invention in Ukraine” and Internet in the specialized database “Inventions (Utility Models) in Ukraine”.

Classification1, preclassification2 (if applicable), and reclassification3 activities; Classification system used, e.g., International Patent Classification (IPC), other classification (please indicate whether or not patent documents are classified by your Office and, if so, which classification is used)

The Ukrainian version of the International Patent Classification (IPC-2012.01) was used for classifying patent documents of Ukraine in 2012.
Within the “Inventions” AS the software system for checking classification symbols is operative. It includes classification guides and specialized software for checking the allotted classification symbols and reclassifying.
In 2012, the complete collection of applications for inventions and utility models was reclassified according to the current Ukrainian version of the IPC-2012.01.

Hybrid system indexing

Domestic deep indexing systems were not used.

Bibliographic data and full-text processing

Information concerning applications for inventions accepted for consideration and registered patents for inventions and utility models is published at the official web-portal of the State Service and the web-site of the UIPI.
Bibliographic data and abstracts are represented in three languages: Ukrainian, Russian and English. Claims and inventions specifications are represented in Ukrainian. The search system enables to carry out full-text search in patent documents, as well as subject-matter, title and numerical searches according to the relative bibliographic data.

IV. Search file establishment and upkeep

File building

The search collection (Patent Information Base – PIB) intended for carrying out patent information searches for the state of the art in the course of the substantive examination of applications for inventions has been in operation since July 1, 1997.
The PIB contains national and foreign patent collections on electronic carriers (CD-ROM and DVD-ROM), first of all of international and regional intellectual property organizations (WIPO, the EPO and the EAPO), leading countries, whose patent documentation is included to the PCT minimum documentation. Documentation available in the search collection has sufficiently deep retrospective. The total collection of patent documentation as on December 31, 2012 contained nearly 14,150 discs.
The search collection of the national patent documentation, which is used in the local mode, includes database “Inventions” AS (bibliographic data) and the Central Electronic Documents Archive (CEDA).
During 2012, the Reference and Information Collection (RIC) of examination which is the PIB constituent was updated by encyclopedias, reference books, legal and instructional and methodological literature, periodicals (including on electronic carriers).
As search collection of non-patent literature, in addition to foreign commercial databases (the List is given in the sub-section “Documentation of the other Offices, processed and/or considered as a part of the available search collection”), during 2012 were also used:
collection of the State Scientific and Technical Library of Russian Federation (under the Agreement on receiving electronic copies of the necessary sources of information from its collection);
free national and foreign Internet resources, in particular, electronic digital libraries, as well as accessible collections of 59 largest national and specialized libraries of Ukraine (first of all electronic), that provided opportunity to receive ordered information resources in the e-document delivery mode.

Updating

Updating of the PIB was implemented by its current acquisition of patent documentation, in particular:
- updating of the database “Inventions” AS and CEDA was implemented routinely by scanning incoming documents, converting them into electronic format and loading to the appropriate databases which are accessible from the web-portal of the State Service and the web-site of the UIPI.
- electronic documents, that are filed through electronic filing application system are loading to the databases in the automation mode;
- foreign patent documents on electronic carriers, which were acquired by the UIPI in the framework of international exchange, were loaded to the electronic data base of the Search Portal.

Storage, including mass storage media


The means of mass storage of data on inventions and utility models used in the UIPI are servers of the electronic databases, Storage Area Network disc data storage systems, optical discs and magnetic tapes.

Documentation from other offices maintained and/or considered part of the available search file

The foreign patent documentation on optical media received by the UIPI in the framework of international co-operation and exchange of patent documentation includes, in particular, the publications of Austria, Great Britain, Canada, Russian Federation, the EAPO and CIS countries, was maintained in 2012.
Therefore, the available search collection of foreign patent documentation, which was used for carrying out examination of applications for inventions and utility models in the UIPI in local mode, includes patent collections of the EPO, WIPO and patent Offices of 51 countries on CD/DVD, converted into database of the Search Portal.
Moreover, to provide effective and qualitative search in the course of examination of applications for inventions and utility models, 8 foreign commercial databases, which within concluded agreements provided access to the PCT minimum documentation (patent documentation and non-patent literature), were used during 2012. These include the following databases: the search system EPOQUE Net (EPO); “Chemical Abstracts Service” (via STN); “Reaxys”, “Derwent World Patent Index”, “ScienceDirect® ArticleChoice™”, web-portal of the WIPO ARDI Program; the database of the All-Union Institute of Scientific and Technical Information of the Russian Academy of Sciences; DB “All Encyclopedias of Rubricon”.
EPOQUE Net search system remained the main search tool among foreign commercial Internet resources as it provided an access of the experts to the patent documentation of the PCT minimum documentation to the full extent.

V. Activities in the field of computerized and other mechanized search systems

In-house systems (online/offline)

The in-house computerized search systems for inventions and utility models comprise those of the “Inventions” AS, the incoming applications Register (E-Register), “Payments Accounting” AS, CEDA and the Search Portal.
CEDA is aimed for storing, processing and searching electronic documents on all kinds of IPOs. Both primary and secondary materials (documents) on applications are accumulated in CEDA. Document presentation formats enable searching these documents by keywords, numbers and dates. Documents are grouped in CEDA according to the application numbers and stored in the PDF format.
The Search Portal with numerous patent databases, (contain data on national patents and applications for inventions and utility models and patent documentation of foreign patent offices, acquired within the framework of international exchange of patent documentation), was introduced in the UIPI for carrying out examination of applications for novelty.
The Search Portal has multifunctional search mechanism and tools for viewing information, allowing:
- carry out full-text search in the selected sources or group of sources;
- view search results for each of the sources;
- turn to a snippet of the text that contains search terms quickly;
- forming search results report;
- keep history of a search queries;
- printing of documents;
- exporting of documents.
To download documents to CEDA, the technology of current scanning of incoming and retrospective documents, their recognition and formats conversion was implemented in CEDA. Its integration with all technology automated systems was carried out for downloading documents to CEDA.
In 2012, the works on converting archival collection of applications on paper carriers into electronic form were continued. The total volume of the CEDA database amount to 2,3 Tbyte.

- IRS “Information about Patents of Ukraine for Inventions (Utility Models) Deemed to be Invalid or Expired”;

- DVD “Official Bulletin “Promyslova Vlasnist”;
- National CD-ROM “Inventions in Ukraine”.

Administrative management systems (e.g., register, legal status, statistics and administrative support)

Administrative support and maintenance of the State Patents Register of Ukraine for inventions and the State Patents Register of Ukraine for utility models is realized by the registry database and the specialized workstation of the State Registry functioning in the environment of the “Inventions” AS. Statistical indicators are collected by special software.

Equipment used (hardware, including the types of terminal and network used, and software), carriers used

Processing of applications for inventions is carried out by means of the “Inventions” AS, which functions in the local computer network (LAN) environment. The following server operating systems are used: Microsoft Windows Server 2008R2, 2008, 2003.
Virtualization technology on virtualization platforms Hiper-V and VMware was implemented.
Up-to-date personal computers with the operating system Windows XP Professional and Windows 7 are used as workstations.
The data storage network is built on the basis of the Fiber Channel technology.
The Search Portal is built on the basis of the web-technology. It functions in the environment under the operating system Red Hat Enterprise Linux Server release 4.
The WebServer: Apache/1.3.41 + mod_php (PHP 5.1.6) is used.
DBMS: PostgreSQL 8.4

Existing online thesauri; their structure, presentation and usefulness for computerized searches

In order to accelerate search and to ensure against errors when forming search requests, electronic dictionaries were integrated into the “Inventions” AS. They include information about patent attorneys, patent classifications and tables of the valid IPC symbols, reference lists of the classification titles, classifiers of the incoming and outgoing documents (letters, requests, demands etc.), classifiers of the kinds of fees, normative, reference and ancillary information.

VI. Administration of the industrial property office library, and information products and services available to the public (relating to facilities, e.g., for lodging applications, for assisting clients on searching procedures, for obtaining official publications and registry extracts)

Collecting, acquisitions, preparation

In order to satisfy public needs for patent information in Ukraine, the Public Patent Documentation Collection (PPDC) functions within the structure of the UIPI branch “Ukrainian Centre of Innovatics and Patent Information Services” (Branch). The PPDC is the most comprehensive patent library in Ukraine available to the public (intellectual property office library).
The main source of foreign patent documentation updating over extended periods remained international cooperation with WIPO, the EPO and international exchange of patent documentation with foreign patent offices. Such international cooperation allowed to accumulate a considerable amount of current and retrospective foreign patent documentation of 4 international and regional intellectual property organizations and 65 countries, first of all on optical carriers, in the State system of intellectual property rights protection.
During 2012 the PPDC was updated by national and foreign patent documentation, first of all on optical discs. As on 29.12.2012, the PPDC numbered over 20.5 thousand copies of official bulletins and nearly 404 thousand copies of patent specifications on paper, and the collection of patent documentation on optical discs exceeded 18.2 thousand items.
Information about the content of the PPDC and its quarterly updates was published in the “Information Resources” section of the web-portal of the State Service (http://www.sips.gov.ua) and the web-sites of the UIPI (http://www.uipv.org) and the Branch (http://www.ip-centr.kiev.ua).
The PPDC is located in the premises of the Branch in the three specially adapted and equipped offices (two stores with a total area of 81 sq. m. and a reading room of 40 sq. m. in area).
The fire safety (fire alarm, alert, fire fighting) was assured; checking of the fire and protection alarm, alarm systems in emergency situations is carried out every year; proper ventilation and air conditioning is ensured.
The PPDC is equipped with 11 up-to-date computers with appropriate licensed software, as well as scanners, printers and xerographic copying machines. In 2012, the replacement of 3 computers with licensed software was carried out.
To enable users to make online access to the electronic patent information resources, such as a Digital Patent Library, the Internet network based on Wi-Fi technology was provided in addition to the traditional Internet access for users’ convenience.

Collection management, preservation

Proper storage of the PPDC documents meeting specified requirements and guaranteeing their safety was ensured.
In particular, visual control of an access of unauthorized persons to the PPDC premises was carried out constantly, that made their access to the documents repositories impossible, and the documents were provided to the users solely in the reading room. Modern technologies for ensuring protection of library collections from theft and damage (video surveillance) were also used.

Information services available to the public (including computerized services and search files contained in libraries remote from your Office and patent information posted by your Office on the World Wide Web)

During the reporting year, with the purpose to complete the patent collections of certain libraries and information centers with national patent documentation, the Official Bulletin “Promyslova Vlasnist” (on paper carrier and DVD) and specifications to patents of Ukraine for inventions and utility models (CD-ROM “Inventions in Ukraine”) were sent free of charge to the bodies of national system of scientific and technical information and some other organizations of Ukraine.
National patent documentation on any carriers was not given in the framework of interlibrary loan as in all above-mentioned patent collections it is kept in 1 copy and is available free of charge on the official web-portal of the State Service and the web-site of the UIPI.
All necessary consultations and services, in particular concerning the preparation of materials for filing of applications to IPOs, better ways to carry out information search, qualified making retrieval schedule, search on CD-ROM and in the remote databases of patent documentation via the Internet etc are provided on the basis of the PPDC (intellectual property office library) as on free of charge basis, as well as on a paid basis.
The List of paid services rendered by the Branch to the general public is posted on its website at: http://www.ip-centr.kiev.ua.
Within the fulfillment of users’ requests, the employees of the Branch provide appropriate services, including carrying out of different types of search of patent information and documentation. In particular, during the 2012:
- 10 sets of the materials for filing an application for invention, 47 sets of the materials for filing an application for utility model were made;
- 732 information searches were carried out, in particular, 70 information searches regarding inventions and 396 searches regarding utility models to conduct a preliminary evaluation of compliance of the declared object with conditions of legal protection; 10 thematic searches according to specific areas of production and technologies, on the results of which were made topical collection of patent documentation (the format of the first page) by countries and years, in particular, in the fields of nanotechnologies, ecology, alternative fuels etc.
The full List of the prepared collections, which can be viewed and purchased, is posted at the website of the Branch.
In general, in 2012 the Branch provided services to nearly 14 thousand users. The PPDC was attended by nearly 150 users, 18% of which were legal entities and 82% – individuals.
With the purpose of popularization of the PPDC and services that are provided on its base, special pages were created at the web-portal of the State Service, the web-sites of the UIPI and the Branch.

Digital patent library (DPL) was created in the State system of legal protection of intellectual property.
In early 2012 the works on development of the first stage of the DPL were completed, including the web site of DPL in the Internet, many directories, information funds, and electronic resources in relation to inventions, utility models, industrial designs. The feature of the DPL is implementation of the mechanisms of pass-through search (search for all funds), full-text search using the Ukrainian morphology and cataloguing of information contents based on the IPC.
From March 1 to December 30, 2012 an experimental operation of the first stage of the DPL was conducted in accordance with the requirements of the State standards. In the mentioned period the services of the DPL were used by more than 25 thousand users.
To ensure feedback with users, a questionnaire, which included a number of questions regarding evaluation of the DPL operation, was integrated into the DPL.
Also, during the experimental operation a module for compilation of statistics that reflects various aspects of use of its information resources was developed and integrated into the DPL.
DPL is posted on the Internet at http://library.ukrpatent.org.

In 2012 the Branch on a commercial basis continued to produce copies of the Official Bulletin “Promyslova Vlasnist on CD-ROM, as well as ensured the functioning of the Internet Exchange Market of Industrial Property, the aim of which is to promote domestic inventions to the market, to encourage the development of inventions and innovative activities, to increase the level of public awareness of the intellectual property importance, to inform the wide range of interested public.
Services provided to the clients of the Internet Exchange Market of Industrial Property in the framework of the agreements were the following:
- compilation, coordination, translation, posting on the web-site and accompaniment the customers’ information about the IPOs;
- work with individuals that have expressed an interest in the IPOs, represented at the Internet Exchange Market of Industrial Property.
During 2012 nearly 2.000 advisory services on the functional activity of the Internet Exchange Market of Industrial Property and the Branch were provided, 15 contracts on placing the information about IPOs on the Internet Exchange Market of Industrial Property were concluded. In general, at the end of 2012 information regarding 154 IPOs was published there.
Administration, information content and work with references of the Branch site users was also provided, in particular, the «Factory of ideas» (information on 50 new ideas, development of technical solutions and “know-how” was included) and the database “Promising Inventions of Ukraine”.
Electronic information catalogues of enterprises and organizations (industrial enterprises of Ukraine, institutes of joint investment of investment business Association, investment funds, techno-parks of Ukraine and CIS countries, business incubators, venture capital companies, higher educational institutions of Ukraine, embassies of foreign States or their representative offices etc), which include around 10,000 direct contacts for execution of the electronic distribution of commercial offers and information materials were created.

VII. Matters concerning mutual exchange of patent documentation and information

Medium used for exchange of priority documents

The functions of international exchange of patent documentation are performed by the UIPI, recognized in 2003 by the law as the Centre of international exchange of publications according to the “Convention on International Exchange of Publications”, adopted in December 3, 1958 by the OON General Conference on the matters of education, science and culture.
In the framework of international exchange of patent documentation the UIPI sent in the 1st half of 2012 the Official Bulletin “Promyslova Vlasnist” on DVD to 26 foreign patent offices and organizations and in the 2nd half of 2012 – to 21. The national CD-ROM “Inventions in Ukraine” was sent in 2012 to 7 foreign patent offices.
In 2012, a two-way communication channel between the UIPI and the International Bureau of WIPO was established through the PCT-EDI system. This channel is used by the Department of International Applications in its capacity as a receiving Office (RO) and designated Office (DO) for documents exchange.
The access to the ePCT system has been also established. By the use of this system the Department of International Applications sends documents converted into electronic form relating to the PCT applications and exercises control on processing of these applications in the International Bureau of WIPO.
Monthly sending the information on the status of the PCT applications in the national phase to the International Bureau of WIPO was organized.
Besides, in the reporting year the UIPI sent to the EPO data on patents of Ukraine (bibliographic data, abstracts in English), including those provided under the Agreement on full access to the EPOQUE Net Service, which ensured a solid foundation for successful bilateral cooperation with this leading office.
Since 2002 in the framework of the relevant interdepartmental agreement Ukraine has been involved in the release of a joint regional patent-information product of the CIS countries on CD-ROM CISPATENT, the technical executor and coordinator of which is the Federal Institute of industrial property (FIPS) of Rospatent.
During 2012, the UIPI provided formation and transfer monthly document files of patent data of Ukraine to FIPS through the created FTP server.
Current discs are published once a month and contain the following information in respect of patent documents of Ukraine:
- bibliographic data and abstracts in Ukrainian, Russian and English;
- claims, full specifications with main and additional drawings in Ukrainian.
In total, in 2012, information about 13,356 patents for inventions and utility models was included in the current editions of CISPATENT, that amounts 28.5% of the total volume of the published documents.
In 2012 the UIPI received 3 copies of the specified disc.

Medium allowed for filing applications

Applications for inventions and utility models are filed in two ways:
- on paper carriers;
- in electronic format by means of the electronic filing applications system;
Filing of the PCT international applications is carried out in PCT-EASY format on optical carriers CD-ROM.

VIII. Other relevant matters concerning education and training in, and promotion of, the use of patent information, including technical assistance to developing countries (please indicate URLs of web pages of the Office’s website wherever appropriate)

In the year under review the State Service, within its competence, took actions on the development and further improvement of the training system and skill upgrading in the field of intellectual property.
The training and retraining activity under the specialty “Intellectual Property” of the Specialist and Master educational programs was carried out in 14 higher education institutions of Ukraine.
In 2012, 269 persons were qualified as Masters under the specialty “Intellectual Property” and 180 persons as Specialists. Intellectual Property Institute of the Odessa National Academy of Law in Kyiv (the Institute), which is the base for training, retraining and skill upgrading in intellectual property, trained 98 Specialists and 80 Masters, including 42 persons under the order of the central government authorities, namely the State Intellectual Property Service of Ukraine, Courts, Security Service of Ukraine, the State Property Fund of Ukraine, Antimonopoly Committee of Ukraine, the Ministry of Justice of Ukraine, Customs Bodies, the State Tax Service of Ukraine and the National Security and Defence Council of Ukraine.
In the reporting period, 4 specialists from Kazakhstan graduated the Institute and were qualified as Masters under the specialty “Intellectual Property”.
Skill upgrading for intellectual property experts was rendered by two education institutions – the Institute and Intersectoral Institute of Postgraduate Education of the National Technical University “Kharkiv Polytechnic Institute”.
In 2012, 62 researchers and teachers from higher education institutions in all regions of the country, and 40 other experts in the field of intellectual property, information analytics and innovation activity completed the advanced courses under the professional program “Intellectual Property” and “Consolidated Information” in the Institute. 27 persons, candidates to the representatives on IP matters (patent attorneys), completed the preliminary courses, and 5 persons completed courses for appraisers of intellectual property rights.
On April 23-25, 2012 the Institute hosted the XII All-Ukrainian Research- to- Practice Conference “Aspects of Training Specialists in Intellectual Property, Information Analytics and Innovation Activity in Ukraine”. The Conference was organized under the auspices of the State Service to analyse the situation and prospects of training specialists in intellectual property, information analytics and innovation activity in Ukraine within the reform of the higher education system and development of national economy based on innovations. Teachers and researchers from higher education institutions, experts from other institutions and organizations took part in the work of the Conference.
In 2012, the State Service organized and conducted 4 conferences and 14 workshops devoted to the wide range of issues relating to intellectual property rights protection.
In September 2012, the XIX International Research-to-Practice Conference “Topical Issues of Intellectual Property” took place in Yalta. Each year Ukraine holds this high-level international event that is important and useful forum for discussion of science, methodical and practical issues in the sphere of intellectual property. It became traditional, and the number of the Ukrainian and foreign participants increases year by year. Thus, experts from Poland, Germany, USA, Georgia, Belarus, Moldova, Lithuania, Kyrgyzstan, Uzbekistan and other countries took part in the Conference.
The basic themes of the conference were: Current status and prospects for the development of the State intellectual property system legal protection; Substantive examination of indications and legal examination: views, approaches and range of problems; Acquiring, use and protection of rights to inventions and utility models; Acquiring, use and protection of rights to indications (trademarks and service marks, brand names, geographical indications), industrial designs and domain names; Prospects for the improvement of the legal protection of copyright and related rights in the information society; International cooperation in the sphere of intellectual property.
In July, the fourth regular International Summer School on Intellectual Property took place in Odessa under the aegis of the National University “Odessa Law Academy”. Representatives from Ukraine, Azerbaijan, Bulgaria, France, India, Iran, Italy, Poland, Portugal, and Slovakia took part in the work of the Summer School. Besides, the WIPO Summer School in Ukraine welcomed Mr. Marcelo Di Pietro, Director of the WIPO Academy that proves the acknowledgement of the successfulness of our school by the WIPO management.
During the year, workshops on other actual issues were held: implementation of electronic document management, digital signature in the process of acquisition of industrial property rights, special aspects associated with the examination of applications for inventions and utility models, role and significance of intellectual property in the innovation driven economic development.
During the year, various round-table discussions, sessions, meetings, and press conferences by the management staff of the State Service involving the leading information agencies, were held.
Specialists of the State system of intellectual property rights protection participated actively in more than 15 conferences and workshops, including international ones, in working meetings and other events, arranged by other organizations in Ukraine.
To support and establish conditions for spiritual, creative and intellectual development in children of Ukraine, to involve the talented student youth to the scientific research and experimental activity, the State Service continues to assist in organization of the week of the all-Ukrainian and international scientific and educational projects “Ukraine-Europe-World” for youth. Within this event, the All-Ukrainian Contest of Young Rationalizers and Innovators “Nature – Human – Production – Ecology”, organized by the Ministry of Education and Science, Youth and Sports of Ukraine in cooperation with the National Ecological Centre for Students was held in Kyiv on February 29 – March 2, 2012. Following the results of the Contest, 30 young rationalizers and innovators, winners of the Contest in branch sections, were awarded with prizes for creative achievements in applied ecology, chemistry, medicine, biology, agricultural research and invention, environmentally sound technologies, energy saving, and physics.
To popularize inventive activity in the great masses of the research and technical society of Ukraine, to encourage employers to implement the results of intellectual activity into production, as well as to find the most promising and prospective developments and to draw attention of the national and foreign entrepreneurs and investors to them, the State Service organizes the annual All-Ukrainian Contest “Invention of the Year”. The Contest is open for enterprises, institutions, organizations, research groups irrespective of their departmental affiliation, proprietary type and location, as well as for individual inventors.
291 patents were submitted to the Contest, 60% of them by the higher education institutions. All submitted patents were discussed in absolute nomination “The Best Invention of the Year”, including 7 patents in the nomination “The Best Invention among Youth”.
The Contest Committee proposed two collective of authors to be awarded with WIPO medal under the category “Women-Inventors”: O. Streltsova, O. Voliuvach, I. Puzyriova, and V. Ehortseva, employees of I. Mechnikov Odesa National University, – inventors of the “Method for water purification from cationic surfactants” (patent No. 95593); and S. Fomina, I. Bagdasarova, L. Myhal, L. Korol, and L. Popova, employees of the Institute of Nephrology of the National Academy of Medical Science of Ukraine, – inventors of the “Method for prediction of efficiency of treatment with glucocorticoids and cytostatics in children with glomerulonephritis with nephrotic syndrome” (patent No. 96065).
On September 27-29, the VIII International Salon of Inventions and New Technologies “New Time”, dedicated to the Day of Innovator and Rationalizer took place in Sevastopol. The State Service and the UIPI were involved in organization of the event as well. The Salon was arranged under the aegis of the International Federation of Inventors’ Associations (IFIA), Programme of the European Union “Cooperation in Urban Development and Dialogue” (CIUDAD), and Sevastopol State Municipal Administration. Representatives from more than 35 world countries took part in it, namely from Azerbaijan, Belgium, Spain, Iran, China, Kyrgyzstan, Korea, Moldova, Germany, Poland, Russian Federation, Romania, USA, Ukraine, Hungary, Estonia, Egypt, and others.
The best projects, presented at the Salon, were awarded with gold, silver and bronze medals, Diplomas of the Salon, as well as with prizes from Sevastopol State Municipal Administration and Sevastopol Municipal Council, Federation of Cosmonautics of Russia, Head of Kharkiv State Regional Administration, Mayor of Mykolaiv, the State Service and the UIPI. The jury rated 560 projects (including around 50% of foreign ones). 512 medals, 70 honorary diplomas, and 60 prizes and other awards of the Salon were handed out.
It should be noted, that within the year 2012 the State Service performed substantive work on organizing conferences, seminars, exhibitions, as well as promotion of creative activities. One of the State Service priority goals is the implementation of an efficient quality management system for the examination of applications for IPOs and reduction of its processing terms.
Based on the results of the audit of a quality management system, conducted by the company Dekra Certification, the examination body was awarded international certificate No. 321012076 dated October 17, 2012 attesting that the quality management system is implemented and operates in the UIPI in accordance with the requirements of ISO Standard 9001:2008 in the following areas:
examination of applications for IPOs (inventions, utility models, industrial designs, trademarks and service marks, integrated circuit topographies, indications of origin of goods) for their compliance with the conditions of legal protection provision, and examination support processes;
provision of measures on preparing for State registration of IPOs and official publication of information about them;
examination and search on applications for inventions under PCT.

X. Other relevant matters

 


1.Classification is allotting one or more classification symbols (e.g., IPC symbols) to a patent application, either before or during search and examination, which symbols are then published with the patent application.

 

2.Preclassification is allotting an initial broad classification symbol (e.g., IPC class or subclass, or administrative unit) to a patent application, using human or automated means for internal administrative purposes (e.g., routing an application to the appropriate examiner).  Usually preclassification is applied by the administration of an office.

 

3.Reclassification is the reconsideration and usually the replacement of one or more previously allotted classification symbols to a patent document, following a revision and the entry into force of a new version of the Classification system (e.g., the IPC).  The new symbols are available on patent databases.
