The highest percentage of applications were filed in the following technical areas: “Organic chemistry” – IPC Class C07 (12% of all filings); “Medical or veterinary science; hygiene” – IPC Class A61 (11.8%); “Agriculture, forestry, animal husbandry…” - IPC Class A01 (5.6%); “Measuring, testing” – IPC class G01 (3.9%).

II. Matters concerning the generation, reproduction, distribution and use of primary and secondary sources of patent information

Publishing, printing, copying (main types of publications of the Office in the field of patent information, etc.)

Information concerning patents and utility models is published in the following official publications of the State Department of Intellectual Property (further - the State Department): the Official Bulletin “Promyslova Vlasnist” (“Industrial Property”) and patent and utility model specifications.
Like in the previous year, the Official Bulletin was issued twice a month. In 2009, 24 issues of the Bulletin were published with the total amount of 1852.96 publisher’s signatures and the circulation of 90 copies, and the Annual Index to the Bulletin for the previous, 2008 year, with the total amount of 203.83 publisher’s signatures and the circulation of 65 copies. 12395 patent specifications were published during the reporting period.
The Official Bulletin “Promyslova Vlasnist” and patent (utility model) specifications of Ukraine were issued both on paper and electronic carriers with the same frequency.
During the reporting year the Official Bulletin “Promyslova Vlasnist” on DVD and the national CD-ROM “Inventions in Ukraine” were sent free of charge to 20 bodies of the National Scientific and Technical Information System and some other organizations of Ukraine and to foreign IP offices in the framework of the international exchange of patent documentation.
The official web-portal of the State Department (http://www.sdip.gov.ua) and the web-site of the State Enterprise “Ukrainian Industrial Property Institute” (further – the Institute) (http://www.ukrpatent.org) contain a number of databases (DB) and information and reference systems (IRS) on inventions (utility models):
- interactive DBs: “Inventions (Utility Models) in Ukraine”, “Information about Invention Applications Accepted for Examination”, “Electronic Version of the Cumulative Official Bulletin “Promyslova Vlasnist”, “Promising Inventions of Ukraine”;
- interactive IRSs: “Invention and Utility Model Applications Processing State”, “Information about Patents of Ukraine for Inventions (Utility Models) Deemed Invalidated and about Lapsed Patents”, “International Patent Classification. Core Level (2009). Ukrainian Version (2009.01)”.
During the reporting year works on enhancing of the DBs and IRSs were carried out in order to improve the performance of their search engines, in particular, the speed of response of the DBs and adequacy of search results to the query. Significant attention was paid to the improvement of the DB and IRS interfaces.
Normative and legal, methodical and reference literature on intellectual property issues was also published, in particular:
- quarterly review “Industrial Property in Figures. The basic indicators of the activities of the State Department of Intellectual Property and the State Enterprise “Ukrainian Industrial Property Institute””;
- scientific and practical periodical "Intellectual Property ";
- user manual “Patent Documentation. Acquisition and Possibilities of Access to it in Ukraine” was prepared for publication at the end of 2009;
- applicants’ guide “How to get a European Patent (Part I)” was translated into Ukrainian within the framework of international cooperation, under the permission of the EPO in order to be placed on the web-portal of the State Department and the web-site of the Institute.

Main types of announcements of the Office in the field of patent information

Information concerning inventions and utility models is published in Book 1 of the Official Bulletin “Promyslova Vlasnist” in the following sections: “Information on the Applications for Inventions Accepted for Examination”, “Information on the Grant of Patents of Ukraine for Inventions”, “Information on the Grant of Declarative Patents of Ukraine for Inventions”, “Information on the Grant of Patents of Ukraine for Utility Models”, in the Indexes to each section and in the “Notifications” section.
Information about inventions on electronic carriers contains bibliographic data, abstracts, claims, invention specifications, drawings, legal status information etc. In 2009 the presentation of information concerning industrial property rights in the “Notifications” section of the DB ”Electronic Version of the Cumulative Official Bulletin “Promyslova Vlasnist” was improved.

Mass storage media used (paper, microforms, optical storage, etc.)

Mass storage media for information about inventions and utility models in the Institute are servers of electronic databases, Storage Area Network disc data storage systems, optical DVDs and magnetic tapes.

Word processing and office automation

A highly productive system of current scanning and recognition of text documents based on the ABBYY Recognition Server 2.0 software was implemented. Digitized documents of applications are accumulated in "electronic dossiers" of applications and stored in the central electronic archive of documents. The central electronic archive of documents is integrated with all technological automated systems.
In 2009, the following functions of the "Inventions" AS were developed and implemented:
- compilation of a list of applications for inventions and utility models, processing of which has been discontinued by the examination body;
- directing such applications to the depository for permanent storage;
- possibility of administration of examiners’ rights in the technological process of documents of applications for inventions and utility models processing.
Also in 2009, software for determining and recording technological working time within the Division of Examination of Applications for Inventions, Utility Models and Integrated Circuits Topographies was developed and integrated into the "Inventions" AS.

(New) techniques used for the generation of patent information (printing, recording, photocomposing, Optical Character Recognition (OCR), etc.)

Preparation of the sections of the publications is carried out automatically by means of the “Inventions” AS software. In order to unify the procedures of automated drawing up of the sections of the Official Bulletin “Promyslova Vlasnist” a set of measures was taken in 2009 to create gateways for receiving data from the existing automated systems, to develop the procedures of presentation of data incoming from the automated systems, in particular, from the "Inventions" AS in the layout of the Official Bulletin “Promyslova Vlasnist”, to create a data consolidation module etc.
The prepared layout of the publication is forwarded to the printing office for replication.

III. Matters concerning abstracting, classifying, reclassifying and indexing of technical information contained in patent documents

Abstracting, reviewing, translating

In the course of 2009, abstracts to make complete the whole backfile collection of patent documents were prepared, translated from Ukrainian into Russian and English and placed into the electronic archive.
Also, during 2009, bibliographic data and abstracts of currently registered patents for inventions and utility models were translated from Ukrainian into Russian and English in monthly batches.
Altogether, during 2009, 1.386.000 documents were placed in the Institute’s central electronic archive, and as of the end of the year, the archive contained over 3,5 million electronic documents concerning inventions, utility models, marks for goods and services and industrial designs.

Classification1, preclassification2 (if applicable), and reclassification3 activities; Classification system used, e.g., International Patent Classification (IPC), other classification (please indicate whether or not patent documents are classified by your Office and, if so, which classification is used)

The International Patent Classification (IPC) is used for classifying patent documents of Ukraine. Since 2006 the core level of the IPC-8 and also, according to the “List of technical fields in which patent documents are to be classified according to the advanced level of the 8th edition of the International Patent Classification” (the List), the advanced level of the IPC has been partially used for classifying patent documents of Ukraine. Considering this state of affairs, according to the Order of the State Department of 3 October 2007 №122, a Ukrainian version of the IPC was established, consisting of the core level extract of the currently effective official text of the IPC for classification symbols not included in the List, and the extract of the currently effective IPC edition for classification symbols and indexing codes included in the List. According to the respective Orders of the State Department, during 2009, the core level of the IPC (2009) and the Ukrainian version of IPC (2009.01) were used.
Within the “Inventions” AS, a software system for checking classification symbols is operative. It includes classification guides and specialized software for checking the allotted classification symbols and reclassifying.
In 2009, the complete collection of applications for inventions and utility models was reclassified according to the current IPC version.

Hybrid system indexing

The Ukrainian version of the IPC used for classifying national patent documents includes hybrid systems, in particular, above 700 indexing codes of the indexing schemes are used together with classification symbols.

Bibliographic data and full-text processing

For the convenience of search bibliographic data, abstracts, claims and specifications are placed in separate fields of the database structure.
A module of full-text search with the function of word form search was developed and put into test operation for the specialised database "Inventions (Utility Models) in Ukraine”.
The collective access database “Information about Invention Applications Accepted for Examination” was restructured to enable operational update of the information contained in it.

IV. Search file establishment and upkeep

File building

For the purpose of search in the course of examination of applications for IPRs the following resources were used by the Institute:
- technological database of the in-house “Inventions” AS;
- Institute’s central electronic document archive;
- patent collections on CD-ROM/DVD (12970 discs) received from the EPO, WIPO and Patent Offices of 51 countries and converted into a single search database;
- foreign patent databases accessed through the Internet (esp@cenet, USPTO, JPO, EAPATIS, PubMed etc.); database of EPOQUE Net Service of the European Patent Office (full access); commercial databases of the Chemical Abstracts Service (via STN), GenomeQuest (the USA), ScienceDirect Article Choice (“Elsevier”, the Netherlands), the VINITI databank (the Russian Federation), DB “All the Encyclopaedias of the Rubricon” (the Russian Federation) etc.

Updating

Updating of the database of the “Inventions” AS and the central electronic document archive is implemented routinely by scanning incoming documents, converting them into electronic format and loading to the databases.

Storage, including mass storage media

The means of mass storage of data on inventions and utility models used at the Institute are the servers of the electronic databases, Storage Area Network disc data storage systems, optical DVDs and magnetic tapes.

Documentation from other offices maintained and/or considered part of the available search file

The foreign patent documentation on optical media received by the Institute in the framework of international co-operation and exchange of patent documentation includes, in particular, the publications of WIPO, the EPO, the USPTO, the Russian Patent Office (Rospatent), the JPO and patent documentation of the former SU Patent Office.

V. Activities in the field of computerized and other mechanized search systems

In-house systems (online/offline)

The in-house computerized search systems for inventions and utility models comprise those of the “Inventions” AS, the incoming applications register, the “Indicators” AS, the central electronic documents archive.
In 2009, automation of the general record keeping for the State Registration Division and the Division of Examination of Applications for Inventions, Utility Models and Integrated Circuit Topographies was going on.
The development of the technical project on the use of a unified document classifier in the environment of the system of registration of the incoming data flow for IPRs applications was completed. The software tools enabling registration of secondary (supplementary) paper documents concerning applications filed primarily by means of electronic filing were developed.
The additional functionality was also implemented in the system of registration of incoming documents that provides the following:
- formation and automatic updating of the database of nonprofit organizations;
- automatic recognition of re-submissions of applications for IPRs.

External databases

For information supply of the public at large, the following interactive DBs accessible via the Internet, and optical data carriers (CD-ROM) were used:

- Collective access DB “Information about Invention Applications Accepted for Examination”;
- DB “Electronic Version of the Cumulative Official Bulletin “Promyslova Vlasnist”;
- DB “Promising Inventions of Ukraine”;

- IRS “Information about Patents of Ukraine for Inventions (Utility Models) Deemed Invalidated and about Lapsed Patents”;
- IRS “International Patent Classification. Core Level (2009). Ukrainian Version (2009.01);
- DVD “Official Bulletin “Promyslova Vlasnist”;
- National CD-ROM “Inventions in Ukraine”.

Administrative management systems (e.g., register, legal status, statistics and administrative support)

Administrative support and maintenance of the State Register are realized by the registry database and the specialized workstation of the State Registry functioning in the environment of the “Inventions” AS. The legal status data are captured in the said database. The statistical indicators are collected by a special software.

Equipment used (hardware, including the types of terminal and network used, and software), carriers used


The “Inventions” AS functions in the LAN environment under the operating systems Windows 2003 Server, Windows Server 2008 and virtualization technology on virtualization platforms Hiper-V and VMware. Up-to-date personal computers with the operating system Windows XP Professional and Windows 7 are used as workstations.
During 2009, 20% of the computer hardware stock was renovated. The examiners’ workstations were fully equipped with new liquid-crystal displays (TFT) with 19-22 inch diagonal screen.
The data storage network is built on the basis of the Fiber Channel technology.

Existing online thesauri; their structure, presentation and usefulness for computerized searches

In order to accelerate searching, to avoid errors when forming search requests, electronic dictionaries were integrated into the “Inventions” AS. They include: information about patent attorneys, patent classifications, tables of the valid IPC symbols, reference lists of the classification titles, classifiers of the incoming and outgoing documents (letters, requests, demands etc.), classifiers of the kinds of fees, normative, reference and ancillary information.

VI. Administration of the industrial property office library, and information products and services available to the public (relating to facilities, e.g., for lodging applications, for assisting clients on searching procedures, for obtaining official publications and registry extracts)

Collecting, acquisitions, preparation

In order to satisfy public needs for patent information in Ukraine, The Public Patent Documentation Collection (PPDC) functions within the structure of the Institute’s branch “Ukrainian Centre of Innovatics and Patent Information Services” (further – the Branch). The PPDC is the most comprehensive patent library in Ukraine available to the public. The PPDC is constantly supplied with national and foreign patent documentation. Official bulletins on paper or electronic carriers, abstracts and specifications are acquired within the framework of international exchange with foreign patent offices and international cooperation with WIPO and the EPO.
However, during the last years, international exchange of patent documentation moved to a new level due to more active use of the Internet for official publications, and as a consequence, the gradual discontinuation by the Offices of traditional publications on paper, CD-ROM or DVD. The exchange of publications on physical carriers progressively turns into the exchange of electronic information via the Internet. This technological process results in a constant decrease of the amounts of data received on different carriers within the framework of international exchange, which makes it impossible to update the PPDC with current patent documentation of an ever growing number of countries.
In 2009, within this process, the following publications ceased to come to Ukraine: the Official Bulletin of the Patent Offices of Estonia, Latvia, Lithuania, Poland, Croatia (on paper), Romania (on CD-ROM), full specifications to the patents of Switzerland on CD-ROM (ESPACE-CH), WIPO publication “WIPO Gazette of International Marks” (on paper).
In spite of these tendencies, during the reporting year the PPDC was updated by a considerable amount of foreign patent documentation, in particular on optical discs.
By the end of 2009, the PPDC numbered nearly 20 thousand copies of official bulletins and 310,36 thousand patent specifications on paper, and the collection of patent documentation on optical discs exceeded 15,28 thousand items.
Information about the content of the PPDC stocks and its updates is posted in the “Information Resources” section of the web-portal of the State Department (http://www.sdip.gov.ua) and the web-site of the Institute (http://www.ukrpatent.org).

Collection management, preservation

The management of the contents, coverage and structure of the document collection was carried out with the due consideration of the users’ needs.
During the last years (including 2009) a large-scale replacement of the information collection hardware by up-to-date computer equipment suitable for operating with the sophisticated software used by patent offices of different countries on CD-ROM and DVD was implemented. The information was transferred from discs and accumulated on the network management server, which significantly accelerated the searching speed.
Great attention was paid to the popularization of the collection: subject collections of patent documentation and a digest of annotations of publications on topical issues of intellectual property rights protection in our country and abroad were published. Publications of prominent specialists from various patent offices – books and journal articles received to update the collection – were annotated.
With the aim to preserve the collection, modern technologies of protecting library stocks from theft, damage and the like are used. Video surveillance, ventilation and air conditioning is continuously in operation, fire safety (fire alarm, fire notification, fire fighting) is ensured.

Information services available to the public (including computerized services and search files contained in libraries remote from your Office and patent information posted by your Office on the World Wide Web)

Formation, management and organization of use of the PPDC is the task of the Information Search Division of the Branch. It makes patent and normative documentation available to all those interested in creation, legal protection and use of IPRs. On users’ requests, the Division carries out different kinds of patent information and documentation searches concerning inventions, utility models, industrial designs, marks for goods and services (bibliographic data, full specifications to patents, abstracts, images etc.). The Information Search Division provides services on qualified drawing up of a search order, i.e. defining the subject of the search, information sources and classification entries of the International Classifications of the IPRs. The Division’s staff, having a good command of several foreign languages, carries out searches on CD-ROM and in remote patent documentation databases on the Internet. Besides, the Division also provides the following services:
- consultations on the content of the PPDC, the most efficient ways of carrying out information search, the reference and search tools exploitation;
- free use of the PPDC reading halls and information materials of free access. These, in the first place, include national patent documentation (Official Bulletin and patent specifications of Ukraine), official bulletins of foreign patent offices, patent information periodicals, normative, scientific and methodical literature, subject and alphabetical catalogues.

VII. Matters concerning mutual exchange of patent documentation and information

Medium used for exchange of priority documents

In the framework of the international exchange of patent documentation the Institute, appointed by the law as the centre of international exchange of publications, sent in 2009 national patent documentation, in particular the Official Bulletin “Promyslova Vlasnist” on DVD to 32 foreign patent offices (36 copies), and the national CD-ROM “Inventions in Ukraine” – to 19 foreign patent offices (21 copies). In its turn, patent documentation from 45 foreign countries and 2 regional intellectual property organizations was supplied to Ukraine.
Besides, in the reporting year the Institute was sending to the EPO data on patents of Ukraine (bibliographic data, abstracts in English), including those provided under the Agreement on full access to the EPOQUE Net Service, which ensured a solid foundation for successful bilateral cooperation with this leading office.

Medium allowed for filing applications

Applications for inventions were filed on paper carriers. Implementation of the electronic document circulation technology and ensuring a transition to the paperless technology of processing applications for IPRs was under way.

VIII. Other relevant matters concerning education and training in, and promotion of, the use of patent information, including technical assistance to developing countries (please indicate URLs of web pages of the Office’s website wherever appropriate)

Assistance furnished by offices to facilitate the changing over of receiving offices to electronic data carriers for the exchange of patent documents (see also fourth sub-item of item VI, above)

In the reporting year the educational institutions in Ukraine continued training, upgrading and improvement of qualification of specialists in the sphere of intellectual property. Training for specialist and master educational and qualification degrees in the speciality “Intellectual Property” was carried out by 16 of the country’s educational institutions. Altogether 507 such specialists were trained in 2009, including 248 masters and 259 specialists.
The State Department together with the State Institute of Intellectual Property (Institute) paid special attention to the training of intellectual property specialists for the executive bodies and the judicial power authorities. Thus, 73 state employees and 11 judges were enrolled to the Institute in 2009, who made up 42% of the total enrolment for the study (200 persons).
The Institute also continued to support the distance learning programme of the WIPO Academy course DL-101 “General Course on Intellectual Property” (Ukrainian-language modules).
In order to upgrade the skills of scientists in the intellectual property field the Institute, supported by the intergovernmental organization “Ukrainian Scientific and Technological Centre”, developed a training programme “Commercialisation of the Results of Scientific Research”.
In 2009 the Institute together with the State Department ensured skills upgrading for teachers of institutions of general education, academic teaching staff active in the field of intellectual property and innovative activity, specialists in technology transfer, namely candidates for technology brokers – all in all over 700 persons.
During the reporting year, the Institute published nine titles of textbooks and manuals in the speciality “Intellectual Property” with the total circulation of approximately 2500 copies.
The creation of an International Training and Scientific Centre was initiated by the Institute. The aim of this Centre’s activity is the realisation of international master’s programmes for training specialists in the field of intellectual property, technology transfer and innovative activities, as well as training of specialists from the CIS countries in the specialities “Intellectual Property”, “Consolidated Information” and “Innovative Activity Management”. In 2009 the Ministry of Education and Science of Ukraine issued this educational institution a licence for carrying out educational activities in training foreign citizens in the basic accredited areas (specialities).
Training of patent attorneys and professional intellectual property rights appraisers remained an important task throughout the reporting period. During the year 7 professional intellectual property rights appraisers and 28 candidates for intellectual property representatives (patent attorneys) were trained.
In 2009 the State Department organized and held 5 conferences, among them 2 international ones, and 14 seminars, including 3 international and 3 regional events, on the current problems related to the acquisition, exploitation and enforcement of IP rights.
In particular, within the framework of the World Intellectual Property Day celebration, a scientific and practical conference “Status and Prospects of Development of the State System of Intellectual Property Rights Protection in Ukraine” was held on April 24, 2009.
From July 20 to July 30, 2009 a two-week WIPO International Intellectual Property Summer School was held on the basis of the Odessa National Academy of Law. This event was initiated by the State Department jointly with WIPO. Its aim was to provide opportunity for senior students and young professionals to improve their knowledge in the field of intellectual property, to demonstrate WIPO’s role in the global administration of intellectual property. Students and teachers from 11 countries of the world took part in the training. It was planned that Intellectual Property Summer School would be an annual event in Ukraine.
The XIV International Scientific and Practical Conference “Current Problems of Intellectual Property” was held from August, 31 to September, 4 (Yalta, Autonomous Republic of Crimea). It has become the basic occasion to discuss the scientific, methodological and practical issues in the intellectual property field.
Over 200 specialists from Ukraine, the Russian Federation, the Republic of Kazakhstan, Latvia, the Republic of Slovenia, the Republic of Poland, the USA, the Czech Republic, Hungary and representatives of international organizations - WIPO and the EPO participated in the conference.
The range of activities of this conference was considerably expanded. In addition to the two plenary and seven branch sessions, three round tables, a seminar, a master-class on the procedures of processing patent applications were held, which was quite new for this forum.
The issues discussed included the current status, problems and prospects of development of the State system of intellectual property rights protection in Ukraine; improvement of the legal regulation in this sphere; patent information support of the examination body operation; improvement of the systems of international registration of trademarks and industrial designs; economic aspects of intellectual property rights, their use and protection.
In order to promote intellectual property-related knowledge and to raise awareness of the youth in the intellectual property basics, the second workbook of the WIPO series intended for 8-14 year-old children “Learn from the Past, Create the Future”, “The Arts and Copyright”, was translated into Ukrainian and published in 2009 with circulation of 2 thousand copies. The first workbook of this series, “Inventions and Patents”, was published in 2008. 700 copies of each of the two workbooks were sent to 112 organizations of Ukraine free of charge.
At the beginning of the reporting year, within the framework of the event “Ukraine-Europe-World”, the all-Ukrainian contest of young innovators and inventors entitled “Nature-Man-Industry-Ecology” was organised by the Ministry of Education and Science jointly with the National Eco-Naturalistic Student Centre in Kyiv.
The 1st All-Ukrainian contest of students’ scientific works was held. 31 students from 18 educational institutions from all regions of Ukraine participated in the contest.
Apart from this, an all-Ukrainian students’ intellectual property competition was established in the reporting year, its organisation being a responsibility of the State Institute of Intellectual Property.

X. Other relevant matters


1.Classification is allotting one or more classification symbols (e.g., IPC symbols) to a patent application, either before or during search and examination, which symbols are then published with the patent application.

2.Preclassification is allotting an initial broad classification symbol (e.g., IPC class or subclass, or administrative unit) to a patent application, using human or automated means for internal administrative purposes (e.g., routing an application to the appropriate examiner).  Usually preclassification is applied by the administration of an office.

3.Reclassification is the reconsideration and usually the replacement of one or more previously allotted classification symbols to a patent document, following a revision and the entry into force of a new version of the Classification system (e.g., the IPC).  The new symbols are available on patent databases.
