Annual Technical Report 2002 on Industrial Design Information Activities submitted by Ukraine (SCIT/ATR/ID/2002/UA)

The expression "industrial designs" covers industrial designs and models. Offices which issue design patents should report their design patent information activities in this series of Annual Technical Reports.

 

I. Evolution of registration activities


Changes experienced in terms of application filings and grants (registrations) with respect to the previous year:
Applications filed:
in 2001 – 1376, in 2002 – 1806, i.e. 31% more with respect to the previous year.
Patents issued:
in 2001 – 1165, in 2002 – 875; 29 % decrease.

Trends and areas experiencing rapid changes with respect to the previous year:
the highest percentage of applications were filed for stationery and office equipment (class 19) – 22%, packages and containers for the transport or handling of goods (class 09) – 10%, articles of adornment (class 11) – 6%.

II. Matters concerning the generation, reproduction, and distribution of industrial design documents and of secondary sources of industrial design information, i.e., official gazettes

Main publications of the State Department of Intellectual Property (hereinafter referred to as the State Department) on industrial designs: normative documents, the official gazette “Promyslova Vlasnist” (“Industrial Property”), in which information about registered industrial design patents (bibliographic data, graphic images) is published.
Beginning with № 10 of 2002 the official gazette “Promyslova Vlasnist” is published in two books: Book 1 “Inventions, Utility Models, Topographies of Integrated Circuits” and Book 2 “Industrial Designs, Marks for Goods and Services, Qualified Appellations of Origin of Goods”.
In every “Promyslova Vlasnist” gazette, current classification and numerical indexes of industrial design patents are published. The annual index to the gazette includes, besides the above-mentioned, a numerical index of applications for industrial designs and a name index of owners of patents for industrial designs.
During 2002, the official gazette “Promyslova Vlasnist” was delivered free of charge to the State Scientific and Technical Library, the Ukrainian Institute of Scientific, Technical and Economic Information, its three branches and 20 Scientific, Technical and Economic Information Centres in different regions of Ukraine. This edition was also disseminated by means of subscription.
In the year 2002, the publication of scientific and practical periodical “Intelektualna Vlasnist”(“Intellectual Property”) continued, in which theoretical and practical issues on the protection of intellectual property were elucidated, official information, normative documents and comments on them, consultations of experts were included. The periodical is published in Ukrainian, its contents – also in Russian and English.
The information on issues of intellectual property protection in Ukraine was available on the website of the State Department of Intellectual Property (the new URL: www.sdip.gov.ua).

III. Matters concerning classifying, reclassifying and indexing of industrial design information according to the classification systems applied


The Ukrainian version of the seventh edition of the International Classification for Industrial Designs (The Locarno Classification) was used. Reclassification and indexing were not carried out.

IV. Search file establishment and upkeep

The search file is composed of retrieval means and the array of input applications.
By the end of the year 2002, the database of the “Promyslovi zrazky” (“Industrial Designs”) automated system comprised data of 9893 applications for industrial designs. During 2002, it was updated with 1462 applications.

V. Activities in the field of computerized search systems for industrial designs


Activities within the framework of complex modernization of the existing “Promyslovi zrazky” automated system plan were carried out. External databases were not used.

VI. Administration of industrial design services available to the public (relating to facilities, e.g., for lodging applications, registering designs, assisting clients with search procedures, obtaining official publications and registry extracts

In the Public Patent Documentation Fund (patent library available to the public), readers were able to use the “Promyslova Vlasnist” official gazette, as well as official bulletins of 39 foreign industrial property offices, which include publications on industrial designs.
Extracts from the Ukrainian State Register of Patents for Industrial Designs were issued on request.
Automated information services were not rendered to the public.

VII. Matters concerning mutual exchange of industrial design documentation and information

Within the framework of international exchange of patent documentation, official bulletins containing industrial design information from 39 foreign industrial property offices were received; in exchange the “Promyslova Vlasnist” official gazette was mailed out. Exchange of machine-readable information was not carried out.

VIII. Matters concerning education and training including technical assistance to developing countries

The State Department coordinates activities concerning the development, improvement and functioning of the system for training of intellectual property specialists in Ukraine. Today, 12 institutes of higher education in Ukraine hold a training license for a specialist’s and master’s degree in the field of intellectual property. Among them, there are the Intellectual Property and Law Institute (IPLI) (Kyiv) and the Inter-Industry Institute for the Staff Upgrading in the New Trends in the Developments of Engineering and Technology, a branch of the Kharkiv State Polytechnic University. In the year 2002, IPLI, in cooperation with leading specialists of the State Department, developed 5 training and methodical manuals, approved for publication by the Ministry of Education and Science of Ukraine. Fundamentals of intellectual property as an academic subject is being introduced in Ukrainian institutes of higher education and in secondary schools.
In 2002, the State Department organized, conducted and took part in 28 conferences, seminars and in more than 20 round-table discussions concerning the protection of intellectual property rights. Among these events, there was the VI International Conference “Present-day Problems of Intellectual Property Rights Protection”, where the discussion of information support problems of the system of IPR protection was one of the most actively developed issues.
