Annual Technical Report 2003 on Patent Information Activities submitted by Kyrgyzstan (SCIT/ATR/PI/2003/KG)

The term "patent" covers utility models and Supplementary Protection Certificates (SPCs). Offices which issue design patents should report their design patent information activities in their Annual Technical Reports on Industrial Design Information Activities.

I. Evolution of patent activities

180 patent applications and 10 utility models applications were filed. 96 inventions and 5 utility models are registered in the State Register.

II. Matters concerning the generation, reproduction, distribution and use of primary and secondary sources of patent information

Publishing, printing, copying (main types of publications of the office in the field of patent information, etc.)

Kyrgyzpatent publishes the Official Bulletin “Intellectualdyk Menchik” (Intellectual Property) which contains official information on inventions, utility models, industrial designs, trade marks, service marks, firm names, selective achievements, computer programs and databases, registered in the State Register as well as information on their legal status. The Official Bulletin is issued in Kyrgyz and Russian. Since 2002 Kyrgyzpatent has published 12 issues annually. In 2003, the Official Bulletin comprised bibliographical data and claims of 80 inventions and 4 utility models.
Bibliographical data, claims and complete descriptions of inventions and utility models are preserved in machine-readable form and in paper copies according to WIPO standards.
The systematic, numerical and nominal index to inventions and service marks, published in 2002 was issued in 2003.
The Official Bulletin and complete descriptions of inventions and utility models are transmitted to the State Patent and Technical Library (SPTL).

III. Matters concerning abstracting, classifying, reclassifying and indexing of technical information contained in patent documents

Summaries of inventions and utility models are published in Russian in paper form. Kyrgyzpatent uses only IPC, other classification is not used.

IV. Search file establishment and upkeep

Informational search for issue of patents of the Kyrgyz Republic under applicant’s responsibility for inventions and utility models shall be carried out by the application’s materials filed by applicants, unrevoked applications with earlier priority, Fund of the issued titles of protection of the Kyrgyz Republic and by published Eurasian applications and patents.
Where the result of the application’s preliminary examination is positive (in the presence of appropriate petition for issue of the patent), the informational search shall be carried out in order to determine the state of the art.

V. Activities in the field of computerized and other mechanized search systems

At present time Kyrgyzpatent has three local networks in three offices which include 35 personal computers. In all three offices an Internet access is available, in two offices Internet access is provided through dedicated channels with speed of 64 kb/second. The total number of computers is 100 units, including Pentium II and lower (53 units), Pentium III and higher (47 units). A reserve of computers is periodically renewed.
In 2003 by the Decree of the Government of the Kyrgyz Republic No.631p of October 16, 2003 Kyrgyzpatent has joined the Agreement “On production of joint regional patent-informational product in optical discs CD-ROM” (CISPATENT).
On the base of bilateral agreement in 2003 Kyrgyzpatent obtained the access to the patent-informational system EAPATIS which was developed by the Eurasian Patent Office.
In 2003 the Kyrgyzpatent’s homepage was improved.

VI. Administration of the industrial property office library and services available to the public (relating to facilities, e.g., for lodging applications, for assisting clients on searching procedures, for obtaining official publications and registry extracts)

Acquisition
Total amount of the funds for industrial property subject-matters in the State Patent Fund as for 1.01.04 is 14.339.451 exemplars (included into 15.215.511 exemplars totally for the State Patent and Technical Library), including 9.476.496 exemplars on CDs and DVDs
Total amount of CDs and DVDs forwarded to the State Patent Fund of the State Patent and Technical Library from Kyrgyzpatent in 2000-2003 (full-text and abstract databases on KG, WO, EP, EA for 21 countries) is 6.594 exemplars
Subscribers’ service
4.139 exemplars of subscribers in the field of industrial property subject-matters in the State Patent Fund of the State Patent and Technical Library from 131 companies.
380593 documents were issued on the requests of subscribers in the field of industrial property subject-matters, including 137 documents on CDs and DVDs (full-text) and 10 documents on Internet databases.
Informational resources on industrial property subject-matters on CDs, DVDs and Internet were used in order to prepare patent searches of the PCT minimum documentation by country in accordance with IPC themes (157 themes).
A nominative bibliography “Inventors KG” for 2001-2002 was prepared and forwarded to the Electronic Information Division in order to put it on the SPTL web-site (288 titles)
Technical reserve
2 automation equipped working places with Internet access (2 PC) and 1 printer are available in the patent subdivision of the State Patent Fund of the SPTL.
The SPF staff (6 persons) are trained in order to familiarize them with appropriate software, databases on CDs and DVDs and with internet search by industrial property subject-matters (60 web-sites of foreign patent offices)
Official gazette “Intellectualdyk Menchik” regularly publishes the data on IP subject-matters registered in the State Register of the Kyrgyz Republic.
Bibliographic data and images of inventions, utility models, industrial designs and full text of descriptions thereof in machine-readable are stored in the Kyrgyzpatent database and in paper carrier according to the WIPO standards.

VII. Matters concerning mutual exchange of patent documentation and information

Kyrgyzpatent realizes the interchange by Official Gazettes with 22 foreign countries and 11 CIS countries.
In 2003 Kyrgyzpatent sent 12 issues of Official Gazettes “Intellectualdyk Menchik”, as well as Enclosures “Annual index” and Annual Report of Kyrgyzpatent.
The magazine “Kyrgyzpatent Bulletin” was directed this year to Offices on Copyright of 11 CIS countries.

VIII. Other relevant matters concerning education and training in, and promotion of, the use of patent information, including technical assistance to developing countries

Specialists of Kyrgyzpatent take part in international seminars and training courses on intellectual property issues.
Interuniversity department “Intellectual Property” implements the teaching of university students and researchers in the field of intellectual property.

IX. Other relevant matters


1.Classification is allotting one or more classification symbols (e.g., IPC symbols) to a patent application, either before or during search and examination, which symbols are then published with the patent application.

2.Preclassification is allotting an initial broad classification symbol (e.g., IPC class or subclass, or administrative unit) to a patent application, using human or automated means for internal administrative purposes (e.g., routing an application to the appropriate examiner).  Usually preclassification is applied by the administration of an office.

3.Reclassification is the reconsideration and usually the replacement of one or more previously allotted classification symbols to a patent document, following a revision and the entry into force of a new version of the Classification system (e.g., the IPC).  The new symbols are available on patent databases.
