Annual Technical Report 2011 on Trademark Information Activities submitted by Kyrgyzstan (CWS/ATR/TM/2011/KG)

I. Evolution of registration activities

Trends or areas experiencing rapid changes with respect to the previous year

Overage duration of applications examination for trademarks since a date of application filing to decision making (refusal or positive) in 2011was 7-12 months as in 2010.

Number of applications for trademarks registration by the national procedure in 2011 increase as compared with 2010 (682 applications in 2010 and 724 applications in 2011). Activity of foreign applicants, filing applications for trademarks registration, increased, too 498 applications in 2010 and 544 – in 2011)

II. Matters concerning the generation, reproduction, and distribution of secondary sources of trademark information, i.e., trademark gazettes

12 numbers of Kyrgyzpatent’s Official Bulletins “Intellectual Property” were issued in 2011 in paper carriers and on CD-ROM. They contains official information about 606 trademarks and service marks, registered in the State Register of Trademarks and Service marks of the Kyrgyz Republic as well as information on prolongation of registration terms of trademarks, annulment of trademarks registration, license agreements on right transfer for trademarks.

III. Matters concerning classifying, reclassifying and indexing of trademark information

Kyrgyzpatent uses the 9th version of the International Classification of Goods and Services (Nice Classification), the International Classification of Figurative Elements of Marks (Vienna Classification) and International Classification of Industrial Designs.

Applicants classify goods and/or services in accordance with their function or destination. It may be possible to take into attention some additional criteria e.g. material of article.

Bibliographic data shall be used for quick information search in databases of trademarks: registration number of application, date of filing, name of a trademark, reference number, ICGS, applicant etc.

IV. Trademark manual search file establishment and upkeep

On the base of agreements on mutual information exchange Kyrgyzpatent permanently receives official editions from foreign patent offices and the CIS countries patent offices. These editions on IP are stored on paper carriers and/or e-carriers in libraries of Kyrgyzpatent.

V. Activities in the field of computerized trademark search systems

To examine applications the Office uses the own database of the Examination Department (SQL+Delphi); the separate interface is provided for every IP subject-matter. In the future it would be possible to use IPAS and PatentscopeWIPO, modernization of in-house database, usage of more advanced software and search methods. The Office is equipped by computers (more than 100 items), printers, scanners, local network and the Internet. Several servers in server room administer works of databases, internal network and the Internet.

The standard license software is used made by Microsoft: Windows XP, Windows 7, Windows Server 2003, Windows Server 2008, SQL Server 2005, MSOffice. Documents are printed and stored generally on paper carriers. Archiving and storage of electronic databases may be provided too.

VI. Administration of trademark information products and services available to the public (relating to facilities, e.g., for lodging applications, registering trademarks, assisting clients with search procedures, obtaining official publications and registry extracts)

For all interested parties the web site Kyrgyzpatent contains all issues of the Official Bulletin “Intellectual Property” for 2011: http://patent.kg/ru/publications/periodicals. Kyrgyzpatent’s libraries give a possibility to consider official bulletins of foreign countries (on paper and/or e-carriers).

All necessary information on trademarks, registration is available by means of consultations. Legislative base on trademarks (application forms, list of documents you may find on the web site of Kyrgyzpatent: www.patent.kg. Applications e-filing at present time is not available.

VII. Matters concerning mutual exchange of trademark documentation and information

International or regional cooperation in the exchange of trademark information, e.g., in the form of official gazettes

According to the agreements on exchange by patent information the Official Bulletins “Intellectual Property” are sent monthly in e-carriers to patent offices of 27 countries. These bulletins are also sent to WIPO, EPO, UPOV, EAPO and libraries of several countries.
In Kyrgyzstan the Official Bulletins were given monthly to regional libraries, libraries of higher institutions and some offices of the KR on paper ande-carriers.

VIII. Matters concerning education and training, including technical assistance to developing countries (please indicate URLs of web pages of the Office’s website wherever appropriate)

The following international events were implemented with participation of Kyrgyzpatent officials:

• The 18th Session of the WIPO Intergovernmental Committee on IP and Genetic Resources, Traditional Knowledge and Folklore (May 3-13, 2011). During the meeting with Dr. Francis Gurry, WIPO Director General, the National Strategy of IP and Innovation Development in the Kyrgyz Republic was discussed, as well as issues of personal representation of regional specialists in the WIPO.

• International Symposium in Muscat (Oman) on the theme: IP and Sustainable Development; Documentation and Registration of Traditional Knowledge and Traditional Cultural Expressions, organized by the WIPO and public organizations of Oman (June 26-28, 2011).

• The 20th joint sitting of the Interstate Council on Issues of Industrial Property Protection and the Joint Work Commission of States-members of the Treaty on Cooperation on Infringements Suppression in the field of IP was held in September 2011 in Minsk (Belarus).

• The Forty-Ninth series of the Assemblies of the Member States of WIPO, including the Patent Cooperation Treaty (PCT) Union Assembly took place in Geneva from September 21 to October 5, 2011.

• The WIPO Global Symposium of IP Authorities “Services for Access to Knowledge in Promoting Innovation and Creativity” was held in Geneva on September 22-23, 2011.

• The International Conference on Knowledge-based Development and Innovative Entrepreneurship took place in Baku (Azerbaijan) on November 24-25, 2011.

• The 6th meeting of the Council on IP Issues under the Integration Committee of Eurasian Economic Community was held in Moscow on December 13-14, 2011.

• Training for Kyrgyzpatent officials in the EAPO, Japanese Office of IP (Tokyo), in the EPO (Munich).

• Two Kyrgyzpatent specialists were trained by the program of the Russian State Academy of Intellectual Property. 9 specialists passed distance learning course of the WIPO – DL-101.
